Jawatankuasa khas MCA bermesyuarat awal 2010

KUALA LUMPUR 28 Dis. - Mesyuarat jawatankuasa khas MCA bagi mengadakan pemilihan semula parti itu dijangka hanya diadakan awal tahun depan.

Timbalan Presiden MCA, Datuk Seri Dr. Chua Soi Lek berkata, mesyuarat terpaksa ditangguhkan kerana kebanyakan ahli jawatankuasa sedang bercuti.

"Kebanyakan anggotanya termasuk dua orang menteri sedang berada di luar negara.

"Lantaran itu, kita tidak dapat mengadakan mesyuarat untuk membincangkan isu berkenaan dengan selanjutnya," katanya dalam kenyataan di sini hari ini.

Setiausaha Agung MCA, Datuk Wong Foon Meng sebelum ini enggan mendedahkan senarai Ahli Jawatankuasa Pusat (CC) parti itu yang telah atau belum menghantar surat peletakan jawatan mereka pada Jumaat lalu iaitu tarikh akhir penyerahan surat tersebut.

Foon Meng berkata, beliau enggan berbuat demikian kerana tidak mahu menimbulkan kekeliruan dalam usaha menyelesaikan kemelut parti itu.

Pemilihan semula pucuk pimpinan MCA itu dilihat sebagai satu cara menyelesaikan kemelut dalaman parti tersebut yang semakin serius apabila Soi Lek dipecat sebagai Timbalan Presiden parti pada Ogos lalu.

Pada 15 Disember lalu, Naib Presiden MCA, Datuk Seri Liow Tiong Lai dan 12 lagi pemimpin parti telah menghantar surat peletakan jawatan mereka sebagai ahli CC kepada Foon Meng.

Bagaimanapun perlembagaan MCA menetapkan sekurang-kurangnya 21 daripada 30 ahli CC yang dipilih oleh perwakilan parti perlu meletakkan jawatan mereka bagi membolehkan pemilihan semula itu diadakan.

Antara yang telah menghantar surat bersama Tiong Lai ialah Timbalan Menteri Belia dan Sukan, Datuk Wee Jeck Seng; Timbalan Menteri Pengajian Tinggi, Datuk Hou Kok Chung; Naib Presiden MCA, Tan Kok Hong dan anggota veteran CC, Datuk Wong Mook Leong.

Dalam pada itu, sebanyak lapan ahli CC lagi turut menghantar surat peletakan jawatan iaitu Lee Wee Kiat, Datuk Yu Chok Tow, Wong Nai Chee, Datuk Yeow Chai Thiam, Datuk Hoh Khai Mun, Datuk Liew Yuen Keong, Datuk Edward Khoo Keok Hai dan Datuk Alex Wong Siong Hwee.

Menurut Soi Lek, Sekretariat MCA akan mengeluarkan surat pemberitahuan kepada media apabila tarikh mesyuarat jawatankuasa khas tersebut diputuskan.

DAP backs Nazri over Utusan

KUALA LUMPUR, Dec 17 — DAP today expressed their support for Datuk Seri Nazri Aziz for criticising Utusan Malaysia’s racist agenda.

The party’s secretary-general Lim Guan Eng said Nazri’s criticism of the Umno-owned newspaper is accurate because Utusan has gone "overboard" in its reporting.

Utusan has gone overboard in its reporting and attacked the non-Malays up to the point of using derogatory terms such as ‘keling’ for the Indian community and calling the non-Malays anti-Islam and anti-Malay. That is the not the spirit of Malaysia supported by the rakyat,” he told reporters in Parliament.

Yesterday, The Malaysian Insider reported that the Umno maverick had condemned the Malay daily for its “outdated” racist propaganda, saying the Umno-owned newspaper must accept that Malaysia is a multi-racial country.

Nazri said Malaysians can no longer accept categorising minorities with derogatory names.

Lim stressed that Utusan was irresponsible for causing racial tension in the country.

“The efforts by Utusan Malaysia are very irresponsible because it causes racial hatred and also publishes false statements like Karpal is anti-Islam. I have also become a victim and that was why I had to sue Utusan but we cannot sue Utusan everyday because we do not have the funds and time to do so,” he said.

The Penang Chief Minister also slammed the Utusan “bosses” for manipulating the news.

“Their reporters are professional but their bosses will change the news and then create false news and false accusations. So we feel that they have gone overboard. I think this is not a political issue but a Malaysian issue.

“Even though we are politically different, the DAP agrees with Nazri in urging Utusan Malaysia to stop this campaign of racial hatred. They will only be satisfied when other races do not have any more rights. If they continue with their campaign of hate, I am scared there will be retaliation that we all will regret,” he said.

Lim hopes that Utusan will accept Nazri’s criticism and change.

“I hope Utusan Malaysia will learn from the criticism made by the minister and also hope that the police will make the necessary investigation to take actions against those who incite racial hatred,” he said.

Utusan has been a mouthpiece for Umno ultra-nationalists and a tool for defending the party’s “Ketuanan Melayu” (Malay supremacy) policy.

The newspaper has also been criticised for being used to attack the opposition and ratcheting up racial tensions.

The Umno-owned newspaper was responsible for running daily stories criticising calls to allow former communist leader Chin Peng to return to Malaysia, linking it to what the newspaper says are moves to question Malay rights.

The paper also suggested that DAP was anti-Islam and said Datuk Seri Anwar Ibrahim was willing to betray the Malays to be prime minister — both incendiary subjects in mainly Malay-Muslim Malaysia.

Its articles have labelled the Chinese community as “pendatang” (immigrants) and the Indian community as “keling”. -MalaysianInsider

MCA polls unlikely

Central committee members reluctant to quit to pave way for fresh mandate

KUALA LUMPUR: Fresh polls may not take place in MCA as many central committee
members are reluctant to quit.

Despite a pledge by deputy president Datuk Seri Dr Chua Soi Lek, vice-president
Datuk Seri Liow Tiong Lai and 12 other CC members to step down to resolve the leadership crisis, none had submitted their letters of resignation.

Secretary-general Datuk Wong Foon Meng told the New Sunday Times he had yet to receive any resignation letter from the 31 elected CC members. Seven more CC members are needed to make up the 21 members — two-thirds of the CC who must resign to pave the way for fresh elections.

“They have until Dec 25 to submit their letters,” Wong said.

On Friday, Dr Chua had said CC members had two weeks to decide whether they wanted to let go of their posts. Liow said he and 12 CC members had received the standard resignation letter and needed time to go through the document.

“I have always emphasised the need for the party to resolve the crisis once and

for all,” he said at a press conference after launching a bio-herbs economic
forum yesterday. Liow said it was important that CC members do what was right to stop the crisis from worsening and urged them to voluntarily resign.

He said many of the elected CC members felt fresh polls were necessary.
“I am confident they will make their decision fast and do not need to be persuaded by others to do what is right.”

But it is said that the remaining 17 CC members are cool towards Liow’s call.
Datuk Chong Itt Chew said he would not sign the letter until the CC briefed members and endorsed the decisions made by the committee on fresh elections. No date has been fixed for the next CC meeting.

“I want to know how many will sign the letter. As far as I know, none have done so despite talk by some leaders.”

Another CC member, Datuk Ti Lian Ker, said he had yet to sign the letter because it was not resolved whether fresh elections would include the Youth and Wanita wings.

“We might set a bad precedent if we allow a minority to get their way and disrupt the party,” he said.

Datuk Tan Chai Ho said he needed time to to think about it as he only received the letter on Friday night.

“It is not easy to get people to resign,” he said.

Universiti Sains Malaysia analyst Dr Sivamurugan Pandian aid if fresh elections did not take place and the status quo remained, it would not guarantee peace in the party.

“If some leaders are unhappy with the developments in the party a few months later, what is going to stop them from creating another crisis?

“I believe fresh polls is the best way to resolve matters once and for all.”

Political analyst Khoo Kay Peng said if all the factions were serious about going for fresh elections, they should have set a date a long time ago. Khoo believed the leaders were dragging their feet to buy time to consolidate their support. He said for now, Liow’s faction was the minority in the
CC after Ong and Dr Chua had teamed up.

“Liow definitely has difficulty in persuading the other CC members to quit. It appears he is running out of options and the only thing for him to do is to wait for the next party elections in 2011.”

Party insiders said there were whispers that some CC members were unwilling to
quit and preferred to complete their term. A CC member, who did not want to be identified, said they had to fight hard to be elected at last year’s party elections but, now, barely a year later, they were facing the prospect of having to vacate their seats to face fresh elections.

“You think it would be easy for us to resign? How about those who are ministers and deputy ministers? They have everything to lose if they do that.”

The MCA leadership crisis was caused by the watershed Oct 10 extraordinary general meeting when party president, Datuk Seri Ong Tee Keat, narrowly lost a vote of no confidence while his former nemesis, Dr Chua, failed to be reinstated as the party’s number two.

再批马哈迪是种族主义之父 纳兹里以其人之道还治其身


纳兹里(Nazri Aziz,右图)今早出席国会面对记者围堵再次发表意见,尽管副首相慕尤丁出访日本跨海替马哈迪辩护,可纳兹里依然炮火不减,他表示尊重慕尤丁的看法,但他坚持自己说对的话,“他(慕尤丁)要发表意见,不要紧啦,那就是他的意见嘛。”














不 过,掌政22年的马哈迪却在此刻发声,认为国家干训局过去的课程并无不妥,惹来纳兹里猛烈炮轰,他多次摆出现任首相纳吉,积极区分马哈迪时代与纳吉的政 策,他说:“(现在的)党纲是什么?不就是一个马来西亚吗?重整国家干训局难道不符合一个马来西亚吗?现在谁是巫统的老板?马哈迪还是纳吉?如果有任何更 动请告诉我,但就我所知,纳吉是现任首相。”



因为国家干训局引起的这场种族主义争议,引发巫统是否为种族主义政党之争,身为巫统重要领袖,纳兹里却强调不应该仇视其他族群,还列举多位运动员如妮柯大卫(Nicole David)、李宗伟为例,说明各族人民不分种族为国奋斗。

Nazri calls Dr M a racist for defending BTN


[本刊记者撰述】国家干训局(Biro Tatanegara)课程 的争议继续烧,纳兹里今日在国会反讥捍卫国家干训局课程的前首相马哈迪是“该死的种族主义者”(bloody racist),并重申内阁之前翻新有关课 程的决定。此外,印度人国大党副主席兼西金马仑区国会议员德瓦马尼(SK Devamany)也承认有关课程内容应该翻新。

除 此之外,巫统所掌控的《马来西亚前锋报》(Utusan Malaysia)与《每日新闻》(Berita Harian)这两周来都刊登了许多捍卫国家 干训局课程的言论,并回击这些反对言论是一些“卖国贼”要把有关课题政治化所导致。其中《马来西亚前锋报》在昨日要求政府不应该向国家干训局的反对声浪妥 协。
尽管国阵内部声浪不一,国阵其他成员党都未评论此课题,但是印度人国大党副主席兼西金马仑区国会议员德瓦马尼(SK Devamany)今日也承认有关课程内容应该翻新。
根据网络媒体《马来西亚局内人》的报道,德瓦马尼了解到,国家干训局扮演的角色是为全国人民筑起爱国主义。“若课程是不利于国民团结,并有违宪法与国家原则(Rukun Negara)及马来西亚的精神,那他们就绝对需要重新检视了。”
国 家干训局课程在过去数周受到各界围攻,民联领袖都指有关课程被用作灌输种族分裂观念的工具。虽然政府一直强调国家干训局课程的主旨是向出席者灌输爱国精 神,惟曾经出席过这课程的参与者却给予相反的证言,被指是巫统透过植入种族憎恶感和‘巫裔拥最高权威(Ketuanan Melayu)’的概念,用作守 住巫裔支持率的工具。
德 瓦马尼(左图黑衣者)透露,他和马华公会总会长翁诗杰曾经向国家首席秘书长西迪哈山(Sidek Hassan)反映这项课题。他指出,他与翁诗杰两人在 去年在会议中有提出国家干训局的问题,因为有当时有报道称课程内容涉及敏感课题,当中就有参与者向他们投诉,但却苦无证据。

KUALA LUMPUR, Dec 7 — Datuk Seri Nazri Aziz has called Tun Dr Mahathir Mohamad a “bloody racist” for defending the Biro Tata Negara (BTN) courses, and reasserted the Cabinet’s earlier decision to overhaul the programme.

Nazri pointed out to reporters in Parliament today that patriotism was not meant only for the Malays but for all Malaysians.

“You must be a Malaysian whether you’re a minister or not. You must walk your talk. Don’t just because when you were PM, you wanted everyone to support you, you’re Malaysian and the moment you’re no longer PM, that’s it, only talk about the Malays so I cannot accept his comment. When you read his blog it is bloody racist.

“I strongly feel the BTN courses must be in line with the 1 Malaysia slogan by the PM,” he said.

Dr Mahathir had said yesterday that there was no need to revamp BTN’s training modules in the current form and that it was suitable for instilling the patriotic spirit among Malaysians.

Nazri also slammed Umno’s Utusan Malaysia newspaper today, saying its “denial syndrome is making me laugh.” The minister in the prime minister’s department repeated his stand that “everybody knows what the BTN is,” so there was nothing to hide.

“I just want them to know, they should not go on a denial syndrome because their syllabus is known to everybody. Don’t think that people outside do not know about the syllabus based on patriotism for Malays. I just want to remind them that among those in the opposition, Hasan Ali was a former deputy director of BTN and Sungai Petani MP Johari Abdul was a BTN former director and Anwar Ibrahim’s father in law was involved with the BTN.

“They all know what the syllabus is all about so who are we to say that it did not happen? You want to lie? You make people laugh. I mean there are people who attended the courses who came out very angry. There were many instances of the use of words like Ketuanan Melayu (Malay supremacy). It is ridiculous so I want them to tell me where did I go wrong in supporting the revamping of the BTN syllabus. Tell me where I went wrong?” he asked.

Nazri stressed that BTN was funded by public money and that the funds should be spent properly for the betterment of all communities.

“The BTN’s allocation is mentioned in the PM’s department’s budget. So it’s public money. So if it’s public money then we need to ensure that it is spent properly, not to have courses only to concentrate on one community in the country.

“You talk about patriotism, love for the country. Patriotism is for all Malaysians regardless of race. Therefore, the money spent on BTN to have courses must reflect the 1Malaysia slogan by the PM. It should not only be to raise patriotism among the Malays. Malaysia is for all races so I disagree with any syllabus which only concentrates on patriotism just on one community, I disagree. If they have a problem with that, I want to know what is their problem,” he said.

Nazri questioned if Utusan Malaysia, which has been at the forefront of defending BTN courses, believes that Malaysia belongs only to the Malay community.

“Do they want to say that Malaysia belongs only to the Malays and the government is only a Malay government? Should only the Malays be given the spirit of patriotism? Other races are not patriotic about their country? So I want them to point out to me where is it that I’ve gone wrong If I disagree with the past syllabus,” he added.

Nazri also denied the claim made by Utusan that it was only him who wanted BTN to be revamped and not the Cabinet.

“The moment PM took over, when he introduced the 1 Malaysia slogan. It was soon after that because courses run by BTN using public funds must be used properly and it amounts to millions so if you want to talk about patriotism, patriotism for all, not just the Malays, for all Malaysians. It’s not because of the Selangor state government that we changed the syllabus so it’s long before that,” he said.

Nazri also questioned Utusan for deceiving Malaysians on BTN.

“You tell me, can I lie? I can’t. They must use their head lah. If they want to deny and all that. If the other side they do not know, it’s different but all these people were involved with BTN before. They were facilitators and directors so they know what’s going on.

“Come on lah, please, this is not 1961 or the 1970s. Information is freely available. I want them to get out of the denial syndrome, admit it and that’s in line with the PM’s slogan so why shouldn’t we change?” he asked.

The PR-led Selangor government recently imposed a ban on its civil servants and students within its state-run educational institutions from attending BTN courses, while Penang — another PR- governed state — is said to be considering similar action.

But the hawks in Umno, through Malay-based dailies like Berita Harian and Utusan Malaysia, have moved to defend BTN and attacked its critics as “traitors” who are trying to politicise the issue.

Utusan yesterday urged the government not to “bow down” to the opposition on BTN and said that it was Nazri who wanted the programme to be revamped even though the move was decided by the Cabinet. - Malaysian Insider

Lembaga Serupa Teoh Kelihatan di bangunan SPRM

Tiga individu mendakwa mereka ternampak satu lembaga yang menyerupai mendiang Teoh Beng Hock merayau-rayau di ibupejabat Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) di Plaza Masalam, Shah Alam.

Menurut laporan akhbar China Press, lembaga tersebut dilihat di tingkat lima bangunan tersebut - tempat Teoh ditemui mati dan di tingkat 14, iaitu pejabat SPRM Selangor.

Laporan itu menyebut seorang pengawal keselamatan dan dua pegawai SPRM terserempak dengan lembaga itu sekitar bulan Oktober lalu - lebih dua bulan selepas Teoh ditemui mati.

Pengawal keselamatan tersebut yang enggan namanya disebut berkata, dia tidak nampak muka lembaga itu, tetapi ia berpakaian sama seperti yang dipakai mendiang ketika datang ke pejabat SPRM dulu.

"Saya nampak mayatnya selepas jatuh. Saya pasti ianya Teoh walaupun saya hanya lihat bahagian belakangnya," katanya sambil menambah kejadian itu berlaku kira-kira jam 6.30 petang.

Ketika mencerita semula kejadian itu, pengawal tersebut berkata dia pergi ke bilik air di tingkat lima di mana secara dia tiba-tiba terdengar bunyi orang berjalan. Pengawal keselamatan yang lain tidak bertugas ketika itu.

"Saya rasa pelik. Biasanya pada waktu itu tiada orang lain di situ. Lalu saya berjalan ke arah tandas... kemudian saya nampak seorang lelaki di depan lif, dia memakai kot hitam dan berseluar putih," katanya.

Pada masa itu, tidak terlintas di fikiran pengawal tersebut bahawa ia adalah lembaga yang menyerupai Teoh itu.

"Saya bertanya dia hendak ke mana kerana tiada orang di atas. Dia menjawab "saya nak naik ke atas", lalu masuk ke dalam lif.

"Ketika itulah saya terfikir yang dia nampak seperti Teoh, jadi saya bergegas ke bilik keselamatan untuk melihat CCTV, tetapi tiada seorang pun dalam lif tersebut.-Malaysiakini

Nazri says no point denying what BTN is

KUALA LUMPUR, Dec 1 – Datuk Seri Nazri Aziz insisted today that the Cabinet wants to overhaul the Biro Tata Negara (BTN), while also admitting the programme had been used to promote certain government leaders.

His remarks come just a few hours after a fellow Umno government leader defended the civics course and insisted it would be “upgraded” instead of “revamped.”

“Whatever word you use, upgrade or revamp ... to me, it is a change of module. Datuk Ahmad Maslan is a member of the Cabinet, he can’t dispute my statement,” he told reporters at Parliament lobby here.

Ahmad, who is deputy minister in the prime minister department, came out defending BTN today against allegations by the opposition that its courses were teaching racial hatred.

He claimed the courses would only be “upgraded”, which means that there is nothing wrong with the modules.

The deputy minister, who is in charge of BTN, claimed that the “upgrade” would incorporate new elements in its lectures to reflect the 1Malaysia idea meant to promote racial unity coined by Prime Minister Datuk Seri Najib Razak.

But Nazri said there was no use in Ahmad or other government ministers denying the Cabinet decision.

Ahmad was the second Umno minister to come out in defence of BTN despite the revelation by Nazri that the Cabinet conceded that its courses were racially divisive.

The first was Deputy Prime Minister Tan Sri Muhyiddin Yasin, who took a similarly defensive stand and publicly stated his views on the issue just hours after Nazri made the disclosure on Monday.

No matter how much leaders tried to deny it, Nazri said, there were “other” former government leaders who are now a part of the opposition vanguards, like PKR de facto Datuk Seri Anwar Ibrahim, who had been involved with BTN and know of its contents.

The BTN was under Anwar when he was then deputy prime minister.

“They know, so what is there to deny,” he said. “What I am saying now is that we are revamping BTN by changing it, which we have decided in the Cabinet meeting so that it is consonant with a 1 Malaysia as wanted by the prime minister.”

Nazri also admitted that BTN was used as a tool to promote certain leaders within the government, which was one of the points used by opposition leaders to demand BTN’s closure.

The minister said BTN was also used as a programme to “instill confidence among the Malays” in the early days of its establishment but stressed that times have changed and “so must BTN”.

DAP: No sense gaining RM1b from GST to lose RM28b to graft

IPOH, Nov 29 – DAP has urged the Federal Government to reconsider the proposed 4 per cent Goods and Services Tax (GST), claiming it would do nothing to narrow the nation’s current deficit budget and would only further burden the poor and the middle class.

Party secretary-general Lim Guan Eng (pic, left) said that the Government should, instead, concentrate on fighting corruption and realising savings of at least RM28bil annually instead of a mere RM1bil in additional revenue from GST.

“This RM28bil was admitted by Second Finance Minister Datuk Seri Ahmad Husni Hanadzlah as the cost of leakages from having closed tenders in government procurement or just failing to have open tenders for government contracts in an open manner.

“If the government focuses on changing this, there is no need to impose GST on the people to raise funds.

“But unfortunately, the Barisan Nasional is not brave enough to truly fight corruption,” he said in his opening address at the Perak DAP’sn 15th annual convention here today.

In fact, Lim pointed out the supposed RM28bil in losses to corruption annually may even be an under-reported figure.

“As Time Magazine had quoted Daniel Lian, a Southeast Asia economist at Morgan Stanley in Singapore, saying that Malaysia might have lost as much as US$100bil since the early 1980s to corruption,” he said.

Lim said that the proposed 4 per cent GST, which is set to be tabled in Parliament early next year, would not widen the tax base much, seeing as the present budget deficit was over RM50bil.

“So what is an additional income of RM1bil annually? In fact, this GST would only serve to affect 85 per cent of the working population who currently do not pay taxes because their incomes are below taxable levels.

“The impact would be most severely felt on the 38 per cent of the 5.6 million households with income levels of less than RM2,000 monthly or 2.12 million households,” he said.

Lim also voiced disappointment over the “unconditional support” for “Umno’s GST” by MCA Gerakan, SUPP and MIC.

“No MCA minister has defended public interest but has continued to perpetuate this national economic divide by burdening the poor and the middle-class instead of fighting corruption to get more money. Why fear fighting corruption so much?” he said.

Lim also called for the withdrawal of the 15 per cent preferential income tax rates given to professionals in selected areas on the Iskandar Development Region, saying that the benefit should be offered to all professionals in Malaysia.

“Why is it that professionals in other states have to pay 26 per cent? How can there be 1 Malaysia when we have one country and two systems with double standards and discrimination in tax treatment?” he questioned.

Kit Siang wants Najib to close down BTN

KUALA LUMPUR - DAP stalwart Lim Kit Siang wants the Najib administration to close down the controversial Biro Tata Negara (BTN) under the Prime Minister’s Department, saying its courses is a major factor for the failure of nation-building.

Pakatan Rakyat (PR) leaders including Lim have accused the ruling Barisan Nasional federal government of using BTN to brainwash civil servants and tertiary students to hate the opposition.

“If Najib is serious, sincere and genuine about the 1 Malaysia concept, the first thing he must do is to close down the BTN as it is the biggest obstacle to 1 Malaysia nation-building," the Ipoh Timur MP said in a statement today.

“The BTN is the litmus test whether Najib’s 1 Malaysia slogan is just empty rhetoric or whether he is really prepared to ‘walk the talk’ of creating a united, harmonious and progressive Malaysia,” he added.

Lim also asked why BTN is not open to public and conducted in secrecy.

“The BTN courses have been shrouded in great secrecy. Not only are participants not allowed their mobile phones and other electronic media gadgets, lectures and course notes are also not allowed to be taken away after the indoctrination,” he added.

PR lawmakers had condemned the BTN for the “brainwashing propaganda” programmes conducted in the course.

According to the lawmakers, BTN courses — compulsory for local university students and civil servants — taught students to hate and was contrary to its original purpose as well as the Constitution.

The Selangor government had recently moved to ban its civil servants, employees of state subsidiaries and students at state-owned education institutions from attending any BTN courses with immediate effect.

Lim was shocked when Deputy Prime Minister Tan Sri Muhyiddin Yassin defended BTN yesterday and claimed that it was not racist but is line with the 1 Malaysia concept.

“It is most shocking that the Deputy Prime Minister, Tan Sri Muhyiddin Yassin, could defend such communal poison in BTN courses,” he said.

The DAP veteran also challenged the government to launch a public inquiry into BTN.

“Is the Cabinet prepared to order a full public inquiry into running of the BTN so that Malaysians can know the truth about the BTN courses and how it deviated from its original purpose to foster nationalism to become a great obstacle to national unity by pumping communal poison and promoting racial ill-will and hatred?” he asked.

Kursus bercanggah 1 Malaysia, DAP mahu Najib tutup BTN

PETALING JAYA, Nov 27 — Penasihat DAP Lim Kit Siang menggesa Perdana Menteri Datuk Seri Najib Razak mengambil tindakan drastik menutup Biro Tatanegara (BTN) atas alasan ia menjadi halangan kepada usaha pembinaan negara, sekali gus bercanggah dengan gagasan 1Malaysia.

"BTN merupakan ujian litmus ke atas gagasan 1 Malaysia yang diperkenalkan oleh Najib sama ada ia hanya satu retorik kosong ataupun sama ada beliau benar-benar bersedia untuk mewujudkan sebuah negara Malaysia yang bersatu, harmoni dan progresif," katanya lagi.

"Kursus-kursus BTN kini diselubungi dengan rahsia besar. Bukan sahaja para peserta tidak dibenarkan membawa telefon bimbit dan peralatan media eletronik yang lain, nota kuliah dan kursus juga tidak dibenarkan dibhawa keluar selepas indoktinasi," kata beliau dalam kenyataan dikeluarkan hari ini.

Najib memperkenalkan gagasan 1 Malaysia apabila mengambil alih kepimpinan kerajaan awal April lalu.

Sehubungan itu, Lim yang juga Ahli Parlimen Ipoh Timor menyoal sama ada Kabinet bersedia untuk mengarahkan agar diadakan satu inkuiri yang menyeluruh berhubung perjalanan BTN bagi membolehkan rakyat mengetahui keadaan sebenar di biro itu, yang terletak di bawah Jabatan Perdana Menteri.

Semalam, Timbalan Perdana Menteri Tan Sri Muhyiddin Yassin mempertahankan peranan BTN sambil menegaskan ia tidak bermotifkan doktrinasi politik sebaliknya ia menerapkan semangat kenegaraan dan perpaduan masyarakat selaras dengan konsep 1 Malaysia.

"Kursus BTN tidak bertujuan untuk membawa peserta-peserta kepada Umno dan Barisan Nasional. Ia tidak mempunyai niat yang jahat, ia mempunyai tujuan-tujuan yang baik," kata Muhyiddin mengulas tindakan kerajaan Selangor kelmarin yang memutuskan untuk melarang kakitangannya dan pelajar institusi pengajian tinggi milik kerajaan negeri itu daripada menghadiri kursus BTN berkuat kuasa serta-merta dengan alasan kononnya kursus BTN adalah satu proses doktrinasi oleh kerajaan Barisan Nasional.

Muhyiddin yang juga Timbalan Presiden Umno berkata kerajaan negeri Selangor dan Menteri Besar Tan Sri Khalid Ibrahim telah diberi gambaran yang salah tentang BTN.

"Masyarakat dan syarikat-syarikat swasta tidak sepatutnya dihalang daripada menghadiri kursus-kursus yang dianjurkan BTN," kata Muhyiddin.

Kerajaan persekutuan, kata Muhyiddin, tetap akan meneruskan kursus-kursus BTN walaupun Selangor mengambil tindakan sedemikian.

巫统秘密进行资产重组 纳吉安插亲信收编资源

【本刊梁志华撰述】有消息指出,自纳吉在今年四月拜相以来,巫统(UMNO)开始针对旗下企业资产进行重组,并委任亲信出任该党资产的首要代理人(chief nominees),负责掌控这些党资产。

新 加坡《海峡时报》(The Straits Times)今天引述负责这起重组计划的巫统高级官员与银行家的报道指出,巫统目前通过数家投资控股公司所持 有的党资产,将会进行一轮重组行动,最终将全部并入一家名为Temasek Padu私人公司的旗帜下。该项重组计划是自纳吉在今年四月上任首相以来,针 对巫统党内事务进行大规模调整的一部分。
受 访的巫统官员与银行家透露,企业重组活动分别由纳吉身边的两名亲信全权负责。这两名亲信分别是现任驻美大使贾马鲁丁(Jamaludin Jarjis) 和企业律师兼Zul Rafique & Partners律师事务所创办人祖吉菲(Zulkifly Rafique)。
《海峡时报》尝试向祖吉菲与贾马鲁丁确认,不过,Zul Rafique & Partners律师事务所的职员表示祖吉菲目前人在国外,而贾马鲁丁也联络不上。
根据公司注册局的资料,祖吉菲与其律师楼的一名律师东姑阿里占(Tunku Alizan Raja Muhammad Alia)是巫统资产新掌门人——Temasek Padu私人公司的股东,持有同样数量的股权。
巫统早在1960年代就涉及商业活动。不过,巫统的企业资产,却是在前首相马哈迪时代(1981年之后)才开始大肆扩张。马哈迪在1984年委任他的亲信,也是巫统总财政的达因(Tun Daim Zainudin)全权负责扩张巫统的党商业利益与企业资产。
根 据巫统官员指出,在马哈迪于2003年把首相棒子交给阿都拉(Abdullah Ahmad Badawi)时,他同时也将党资产与超过马币10亿元的现 金,转移到阿都拉手中。而阿都拉在接手后,委任银行家阿都阿金(Abdul Azim Zabidi)为巫统的总财政。后者通过重组巫统旗下的企业控股, 把这些党资产通过数家控股公司来分别掌控,包括Realmild 控股, Pesaka Consolidated 以及Temasek Padu。
巫 统原任的首要代理人是一位名叫拉迪夫(Latif Abdullah)的商人,与阿都拉关系密切。而巫统官员与银行家口中所说的。该名即将遭撤换的首要代 理人,就是拉迪夫。据悉,拉迪夫将把巫统的党资产,从Realmild控股转移到由纳吉亲信控制的Temasek Padu。
同时,纳吉也把原任巫统总财政阿金撤换,改由自己的亲信,也是第二财长的胡斯尼(Mohd Husni Hanadzlah)出任该职务,以全面掌控巫统的资产。
负 责该计划的巫统官员与银行家透露,在这项由纳吉主导的企业重组计划下,Temasek Padu将接手Realmild控股所有党资产,包括医疗服务公司 Radicare与造船公司Labuan Shipyard & Engineering。同时,Temasek Padu也会接手 Pesaka Consolidated 所持有的一家位于玻璃市的能源发电厂的股权。
根据公司注册局的 资料,Temasek Padu是在2005年成立,在一些企业持有大批股权,包括负责营运吉隆坡以外的机场总站的Subang Skypark,一家名 为Pandan Village的产业控股公司,以及在印尼分销电脑与电子产品的 Mahkota Technologies and Canas Unggul。

Who is lying – father (2nd PM Tun Razak) or son (6th PM Najib Razak)?

I asked in Parliament today – “Who is lying – father (second Prime Minister Tun Razak) or son (sixth Prime Minister Datuk Seri Najib Razak”?

This was during the committee stage debate on the Prime Minister’s Department on the 2010 budget in Parliament.

On 3rd November, while replying during question time, Najib told Parliament that from a legal aspect, states such as Kelantan and Trengganu are not entitled to oil royalties for petroleum produced “off-shore” - as they are only entitled to oil royalties if the petroleum is drilled from its water.

Najib said:

“The offshore oil operations in their waters are defined as an area not more than three nautical miles, which is measured starting from the low watermark or the shoreline of the state.

“Currently, there is no oil production in the waters of Kelantan or Terengganu. Because of that, from the legal standpoint, Kelantan does not have a right to demand oil royalties, the same as Terengganu”.

This was in clear contradiction to the answer given by Najib’s father, Tun Razak when he replied to my question as the second Prime Minister in Parliament on the same issue 24 years ago in 1975.

This is the Q & A from Parliament Hansard of November 12, 1975:

Tuan Lim Kit Siang minta Perdana Menteri menyatakan samada semua negeri di Semenanjung Malaysia, Sarawak dan Sabah telah menandatangani perjanjian dengan Petronas untuk mencarigali minyak di sepanjang pantai dan samada perjanjian tersebut mengandungi apa-apa syarat dan kepentingan bersama. Nyatakan juga keuntungan bersama yang akan diterima oleh tiap-tiap negeri.

Perdana Menteri (Tun Razak): Tuan Yang di-Pertua, semua negeri di Malaysia, melainkan Sabah dan Selangor, telah menandatangani perjanjian dengan Petronas sebagaimana yang dikehendaki oleh Akta Kemajuan Petrolium, 1974. Saya diberitahu Kerajaan Negeri Selangor pun telah bersetuju menandatangani perjanjian ini. Mengikut Perjanjian itu, tiap-tiap negeri akan menerima 5% daripada nilai petrolium yang dijumpai dan diperolehi di negeri masing-masing samada yang diperolehi dalam kawasan perairan atau di luar perairan negeri tersebut, yang dijual oleh Petronas ataupun ejensi-ejensi ataupun konraktor-kontraktornya.

I called on the son and the sixth Prime Minister to keep to the commitment by the father and the second Prime Minister that Kelantan and Trengganu are entititled to 5% oil royalty for petroleum “whether onshore or offshore” as stipulated in the Petroleum Development Act 1974 (one of whose architects is Tengku Razaleigh Hamzah who had rightly spoken up on the legal rights of Kelantan and Terengganu to 5% oil royalty for petroleum produced offshore and not as mere “wang ehsan”).

Otherwise, Najib’s 1Malaysia would be sheer mockery if the legal rights and status of states to oil royalty is politicized to depend on whether Umno/Barisan Nasional controls the state government, as happened to Terengganu and Kelantan.

Muhyiddin 'Tukang Jaga mulut MCA'

Tan Sri Muhyiddin Yassin sudah menjadi tukang jaga mulut MCA dengan meminta semua pemimpin MCA agar tidak mengeluarkan kenyataan kerana ia menunjukkan berlaku percanggahan yang berlarutan.

Timbalan perdana menteri itu berkata, sekiranya berlaku sebaliknya, proses mencari formula penyelesaian kemelut dalaman parti itu tidak ditemui.

Beliau dipetik Bernama ketika diminta mengulas mengenai pelbagai pandangan dan kenyataan yang dikeluarkan oleh pemimpin-pemimpin MCA dalam menyelesaikan kemelut parti itu.

Muhyiddin, yang juga timbalan pengerusi BN, berkata memang wujud perbezaan pendapat dalam kalangan pemimpin MCA dan itulah sebabnya jalan penyelesaian dicari agar ada kesepakatan dalam membuat keputusan bagi menyelesaikan masalah.

"Jadi, sementara belum selesai, tak perlulah keluarkan kenyataan. Kita berdiam diri sahajalah dan ini tidak akan menjejaskan kredibiliti mereka," katanya.

Ditanya mengenai dakwaan sesetengah pihak bahawa campur tangan Perdana Menteri Datuk Seri Najib Razak dan beliau dalam MCA ketika sokongan terhadap Presiden MCA Datuk Seri Ong Tee Keat telah kukuh, Muhyiddin berkata:

"Kami pun tidak berminat dari awal tetapi perdana menteri sebagai pengerusi BN melihat situasi sudah lebih daripada gawat."

Beliau berkata itu mungkin pandangan pihak tertentu kerana kepentingan puak-puak tertentu.

"Semua, jika ditanya, akan bersetuju dengan pandangan itu (bahawa masalah MCA semakin gawat) dan tidak ada pihak yang mengatakan bahawa MCA bertambah kuat," katanya.

Timbalan perdana menteri berkata peranan beliau dan perdana menteri bukan untuk campur tangan.

"Saya banyak kerja lain pun...ini nak ada pilihan raya kecil, ada kawasan banjir, (dan banyak) urusan lain tetapi oleh kerana kita lihat ini suatu yang amat penting dalam soal BN, maka sudah sampai waktu Presiden parti dan pengerusi BN, dan saya diarah untuk mengambil sedikit peranan.

"Dan apa pun, itu terserah kepada mereka juga. Kami tidak boleh paksa, kami akan bincang dan jika dapat kami cari jalan, semua pihak boleh bersetuju formula itu, maka itu formula mereka, bukan formula kita. Kita jadi orang tengah sahaja," katanya.

Muhyiddin berkata beliau telah menemui pemimpin MCA bermula semalam.

Mustahil kemelut MCA diselesaikan sepenuhnya

Akhirnya, Pengerusi Barisan Nasional merangkap Presiden UMNO, Najib Abdul Razak terpaksa mengakui bahawa krisis MCA semakin serius dan buruk. Mesyuarat Agung Luar Biasa (EGM), dan Pelan Perpaduan kemudiannya berakhir dengan tangisan dua orang ketua sayap MCA, Wee Ka Siong (Pemuda) dan Chew Mei Fun (Wanita) pada 18 November 2009.

Antara jalan penyelesaian yang dicadangkan termasuklah EGM kedua dan pemilihan semula dalam parti, seperti yang didesak oleh puak Liow Tiong Lai sebelum ini. Jikalau dilihat senario terkini, iaitu insiden "pancungan kepala 9 orang" dari Majlis Presiden, maka tuntutan ini nampaknya hanya boleh dipenuhi dengan campur tangan Najib Razak.

Persoalannya, apakah EGM kedua dan pemilihan semula itu bakal menyelesaikan kemelut MCA dengan 100%?

EGM dan pemilihan semula

Senario terkini menyaksikan bagaimana Presiden MCA, Ong Tee Keat berganding dengan musuhnya sebelum ini, Chua Soi Lek untuk bertempur dengan puak yang mendesak kedua-dua mereka berundur. Liow Tiong Lai menjadi pemimpin yang "ditonjolkan" (bukan menonjol) oleh puak ini untuk berperang dengan Ong-Chua.

Sebaliknya, Ong Tee Keat pula menyatakan bahawa dirinya bersedia untuk melapangkan dada agar "menerima semula" Liow, dengan mendakwa bahawa Liow sebenarnya dihasut oleh "orang-orang tertentu" untuk menentang Pelan Perpaduan. "Keterbukaan" Ong ini juga boleh dibaca sebagai strategi untuk memecah-belahkan antara Liow Tiong Lai, Wee Ka Siong dengan Chew Mei Fun. Gambaran semakin jelas apabila Wee dan Chew disingkir oleh Ong Tee Keat dari Majlis Presiden, sementara Liow dikekalkan pada 18 November.

Di samping itu, EGM kedua yang cuba dipanggil oleh "kumpulan pendesak" turut digagalkan dalam mesyuarat Jawatankuasa Pusat pada 18 November, dengan 23 undi menentang 10 undi (2 undi berkecuali). Dengan kata lain, puak Liow menemui jalan buntu untuk merombak semula pucuk pimpinan tertinggi, malah semakin ramai orang Ong-Chua dimasukkan ke dalam Majlis Presiden dan Jawatankuasa Pusat MCA.

Mengapa EGM kedua digagalkan? Jawapannya mungkin boleh ditemui seandainya pertanyaan ditujukan kepada "siapa yang paling berisiko seandainya EGM dan pemilihan semula diadakan?"

Perubahan lanskap kuasa

Jawapannya, Ong Tee Keat. Ong yang pada mulanya ingin mencantas Timbalannya, Chua Soi Lek, kini perlu berdepan dengan realiti bahawa "tiada jalan lain kecuali bekerjasama dengan Chua". Retakan yang berlaku dalam puak Ong sendiri, menyebabkan Ong semakin bergantung kepada Chua untuk mempertahankan kedudukannya.

Asas yang menyokong Ong sebagai Presiden MCA ialah Pelan Perpaduan, hasil muafakat antara Ong dengan Chua. Maka, beberapa rombakan pucuk pimpinan selepas Pelan Perpaduan menyaksikan bagaimana orang-orang Chua, seperti anaknya, Chua Tee Yong, Tan Chai Ho, Gan Ping Sieu dan lain-lain lagi dimasukkan ke dalam pucuk pimpinan, sama ada Majlis Presiden mahupun Jawatankuasa Pusat.

Percaturan sedemikian bukan sahaja untuk menghakis pengaruh puak Liow, tetapi pada masa yang sama mengukuhkan pengaruh Chua. Chua Soi Lek sebelum 26 Ogos 2009 dilihat keseorangan sebagai Timbalan, kehilangan segala-galanya pada 26 Ogos, dan hanya mampu mengembalikan keahliannya pada 10 Oktober. Namun, kuasa Chua kini bertambah selepas rombakan demi rombakan, malah kembali menguasai Johor sebagai Pengerusi MCA di negeri itu.

Jelas, Chua memilih untuk bekerjasama dengan Ong atas kepentingan bersama. Hakisan kuasa pada puak Liow tidak menjejaskan kepentingan Chua. Senario terkini memperlihatkan bagaimana kuasa Chua semakin berkembang, sementara puak Ong (pada asalnya) semakin meretak.

Maka, jika EGM kedua atau pemilihan parti diadakan dalam masa terdekat, siapa pula yang akan memperolehi kelebihan? Ong sememangnya akan berwaspada kepada Chua, kerana "kawannya" kini adalah "bekas musuh", dan berpotensi menjadi "bakal musuh". Chua mungkin menjadi calon yang menentang Ong, ataupun sabotaj Ong pada saat terakhir, seandainya pemilihan parti diadakan.

Ong pula tidak dapat berdiri atas kaki sendiri, lebih-lebih lagi anak buahnya telah meninggalkannya. Ong sebelum ini bangkit kerana "imej moral"-nya, dilihat oleh akar umbi sebagai pemimpin yang lantang bersuara dalam isu kepentingan kaum. Namun, kemelut parti yang berlanjutan untuk beberapa bulan ini sedikit sebanyak mencalar imejnya itu.

Oleh itu, pemilihan parti semestinya bukan jalan penyelesaian dari kaca mata Ong.

Campur tangan Najib

Kemungkinan perundingan antara Ong-Chua dengan puak Liow dimatikan begitu sahaja. Pendek kata, kepentingan Ong menghadapi risiko jika diadakan pemilihan semula, sementara kepentingan puak Liow tidak terjamin dalam struktur kuasa yang sedia ada.

Maka, Najib (gambar kiri) terpaksa mencampur tangan pada saat-saat yang genting ini. Persoalannya, apakah campur tangan Najib bakal menyelesaikan kemelut MCA?

Ketika puak Liow bernaung di bawah Ong Tee Keat, salah satu tuduhan terhadap Chua adalah cubaannya untuk mengundang kuasa dari luar parti untuk mencampur tangan dalam hal ehwal dalaman parti. Maka, jikalau puak Liow kini mengangguk kepada campur tangan Najib, mereka semestinya akan dilempar dengan tuduhan yang sama.

Malah, jikalau sentimen ini dimainkan, mereka semestinya akan dilabel sebagai pengkhianat parti. Misalnya, Ti Lian Ker, pemimpin muda yang terserlah sebagai penyokong setia Ong, telah menuduh Wee dan Chew seolah-olahnya disokong oleh "political godfather". Maksud tersiratnya terlalu nyata untuk dibaca.

Dalam keadaan sebegini, Najib menghadapi kesukaran untuk meleraikan kemelut ini, lebih-lebih lagi jikalau kesudahannya tidak memenuhi tuntutan semua pihak.

Misalnya, jikalau EGM kedua dibatalkan dengan syarat pemilihan semula diadakan, Ong akan bangkit menentang; jikalau Liow dikekalkan jawatan parti dan dalam kabinet, dengan syarat pemilihan dibatalkan, puak Liow akan meretak kerana Wee dan Chew akan menganggap dirinya dikhianati Liow; jikalau pemilihan diadakan dalam tempoh yang dipersetujui ketiga-tiga pihak, iaitu Ong-Chua-Liow, kemelut ini akan berlanjutan sepanjang tempoh ini.

Ringkasnya, tiada penyelesaian sebenarnya untuk kemelut MCA!

Punca kemelut gagal diselesaikan

Najib semestinya menyedari bahawa seandainya pemilihan diadakan, maka MCA akan berperang lagi sesama sendiri. Persoalannya, apakah puncanya yang menjadikan kemelut ini gagal diselesaikan?

Melihat kepada senario terkini, secara kasar, MCA kini berpecah kepada tiga puak, yang masing-masing diketuai Ong Tee Keat, Chua Soi Lek dan Liow Tiong Lai. Tiada antara mereka yang mampu menguasai MCA secara 100%. Senario ini lumrah di setiap parti kerana tiada orang yang boleh menguasai 100% parti.

Masalah wujud apabila mereka yang gagal menguasai 100% itu, mahu tuntutan mereka dipenuhi 100%. Ini yang menyebabkan kemelut MCA gagal diselesaikan sehingga hari ini. Kerana dahagakan penguasaan 100%, maka Ong cuba mencantas Chua. Kerana mahukan penguasaan 100%, ganding Ong-Chua kini memancung kepala puak Liow. Selagi pemimpin MCA terperangkap dengan mental sedemikian, kemelut MCA gagal diselesaikan.

PAS mungkin mengambil iktibar daripada EGM MCA untuk menggagalkan Muktamar Khas. Ironinya, MCA kini mungkin boleh mencuri konsep "Kerajaan Perpaduan" yang sudah dikunci ketat oleh PAS, untuk digunakan dalam pengagihan kuasa dalam partinya itu.

Setiausaha politik Ong letak jawatan

KUALA LUMPUR 20 Nov. — Simon Lim, pembantu kanan presiden MCA dan Menteri Pengangkutan Datuk Seri Ong Tee Keat meletak jawatan selepas mesyuarat jawatankuasa pusat MCA pada Rabu.

Lim, yang merupakan setiausaha politik kepada Ong, berkata beliau menyerahkan sendiri surat perletakan jawatannya, yang bertarikh 18 Nov kepada Ong dengan satu salinan kepada Perdana Menteri.

"Saya menyerahkan sendiri kepada beliau di pejabat beliau di Kementerian Pengangkutan selepas mesyuarat jawatankuasa pusat. Perletakan jawatan saya akan berkuatkuasa 1 Dis,” katanya kepada Bernama di sini hari ini.

Menyatakan keputusannya itu disebabkan alasan peribadi, Lim berkata beliau mahu kembali kepada bidang guaman di mana beliau pernah menjadi rakan kongsi kanan dalam syarikat guaman, Simon and Co.

"Sebenarnya saya merancang untuk kembali ke bidang guaman selepas mesyuarat agung luar biasa MCA yang lepas (10 Okt). Sekarang saya fikir ia adalah masa yang sesuai untuk berbuat demikian,” katanya.

Bagaimanapun, beliau enggan mengulas sama ada perletakan jawatannya itu mempunyai kaitan dengan spekulasi behawa beliau tidak bersetuju dengan keputusan Ong merombak Majlis Presiden MCA baru-baru ini.

Student protesters call for 'democracy' in MCA

KUALA LUMPUR: In a rare show of dissent, a small group consisting of mostly students held a candlelight vigil at the MCA headquarters here last night.

Numbering around 60, the demonstrators held candles and sang for over an hour before they were dispersed by the police.

According to the group's spokesperson Lai Chee Hoe, who declined to say which division he is from, the vigil was to express their disappointment over the latest happenings in MCA.

"We are a group of people who are very disappointed with what has happened in MCA. We are not aligned to any faction. We want the MCA leaders to respect democracy," said Lai.

Lai, however, declined to elaborate what "respect democracy" meant.

Apart from the confiscation of several banners by the police, the demonstration was a non-event.

The banners bearing pictures of MCA president Datuk Seri Ong Tee Keat and his deputy Datuk Seri Dr Chua Soi Lek said the two had caused the community to lose credibility and the party cannot be rejuvenated with the two as its leaders.

It also said Chua was shameless to hold on to the deputy president's position.

Another MCA member, Chong Sin Woon, who claimed that he is from the Pandan division, said that fresh polls were necessary to restore confidence in the party.

Bar Council hails Karpal

Senior lawyer should be given chance to prosecute Lingam

THE Malaysian Bar Council has welcomed the offer by senior lawyer Karpal Singh to accept the challenge posed by the Prime Minister’s Department by volunteering to prosecute Datuk V.K. Lingam.

Council chairman Ragunath Kesavan(picture left), when contacted by Malay Mail, yesterday said it was a good move by Karpal to offer his expertise in such a case.

Since the Minister Datuk Seri Nazri Aziz had mentioned that his office was looking for volunteers to prosecute Lingam, the challenge was open to any practising lawyer with the expertise. Nazri challenged anyone, including Karpal, who could provide him with a relevant section in Malaysian law to charge Lingam — who was implicated in the 2007 videoclip showing him apparently making deals over the appointment of judges.

“It was an open challenge, therefore it could have been anyone, if not Karpal. Since Karpal has the specialty in this case, he should be given a chance as this is not a new thing, where a lawyer in private practice is allowed to prosecute a case for the State,” he said.

However, Ragunath said Karpal will still need to get permission from the Attorney-General Tan Sri Abdul Gani Patail.

Karpal had volunteered to take on the challenge issued by Nazri, who on Tuesday said his office was looking for volunteers to prosecute Lingam, at no charge.

Karpal, after accepting the challenge, yesterday urged the AG to authorise him to act for the government over the issue as Nazri had also said that he would speak to the AG if someone was willing to prosecute Lingam.
In making his suggestion, Karpal said he would charge Lingam under Section 4 of the Sedition Act, which carries a maximum penalty of RM5,000 or three years’ imprisonment or both.

He also wants a written consent, as required under Section 5 of the Sedition Act, to prosecute on behalf of the State and also the investigation file into the video clip affair.

Nazri was quoted last week as saying that Lingam had not broken the law for allegedly lobbying for the appointment of judges and that there was no provision in the law to say that those caught doing so had-MMail

KUALA LUMPUR, 18 Nov (Bernama) -- Penasihat DAP Karpal Singh sedia menawarkan khidmat sukarelanya mendakwa tokoh kontroversi dalam isu 'klip video Lingam', Datuk V. K. Lingam sekiranya Peguam Negara (AG) Tan Sri Abdul Gani Patail membenarkan beliau berbuat demikian.

"Saya menyeru Menteri di Jabatan Perdana Menteri Datuk Seri Mohamed Nazri Aziz supaya menasihati AG mengeluarkan 'fiat' kepada saya bagi tujuan mendakwa Lingam," katanya kepada pemberita di lobi parlimen di sini Rabu.

(Fiat ialah perintah atau waran singkat oleh hakim atau majistret agar sesuatu tindakan dilakukan).

Semalam, Mohamed Nazri berkata Jabatan Perdana Menteri sedang mencari sukarelawan bagi mendakwa peguam kontroversi itu atas tuduhan mengatur pelantikan hakim yang dirakam dalam satu klip video.

Mohamed Nazri berkata beliau akan berbincang dengan Peguam Negara jika ada sesiapa yang bersedia mendakwa Lingam, termasuk Karpal Singh.

Kata Karpal: "Saya sambut cabaran itu. Saya bersedia mendakwa V. K. Lingam bagi kesalahan mengikut Seksyen 4 Akta Hasutan. Apa yang diucapkannya (dalam video berkenaan) mempunyai kecenderungan ke arah menghasut.

"Dalam perkataan lain, perkara ini termasuk di bawah Seksyen 3(1c) Akta Hasutan, yang mentakrifkan kecenderungan untuk menghasut sebagai kecenderungan untuk menghina atau mewujudkan kebencian terhadap bidang kehakiman di negara ini, yang boleh dikenakan denda maksimum RM5,000 atau tiga tahun penjara atau kedua-duanya sekali."

Beliau berkata di England, adalah perkara biasa bagi Peguam Diraja atau pengamal undang-undang bebas untuk bertindak sebagai pendakwa, sekiranya kerajaan membenarkan mereka berbuat demikian.

Karpal berkata mengikut Seksyen 5 akta yang sama, "tiada seorang pun boleh didakwa bagi kesalahan mengikut Seksyen 4, tanpa mendapat kebenaran Pendakwa Raya.

"Jika AG bersetuju...saya tak nampak ada sebab kenapa Nazri tidak bersetuju untuk memberi kebenarannya secara bertulis, jika diambil kira kenyataan menteri itu di lobi parlimen semalam," katanya.

"Pemimpin MCA ada masalah kewibawaan" - Ong Ka Chuan

Kemelut dan krisis berpanjangan dalam MCA adalah dilihat sebagai gambaran kelemahan pemimpinnya dalam menangani masalah sedia ada.

Apatah lagi tentang kewujudan dua Timbalan Presiden MCA setelah keputusan EGM tempoh hari tidak 'dipatuhi' sepenunhnya menyebabkan situasi gawat terus melanda parti komponen Barisan Nsional (BN) itu.

Demikian kenyataan yang dinyatakan sendiri oleh Pengerusi MCA bahagian Tapah Dato' Seri Ong Ka Chuan dalam sidang medianya di lobi Parlimen sebentar tadi.

"Presiden MCA tidak memaklumkan adanya rundingan dengan Timbalan Presiden Dato' Seri Chua Soi Lek sehingga wujudnya pelantikan timbalan baru iaitu Dato' Seri Liow Tiong Lai.

"Saya kesal dengan apa yang berlaku dan dengan adanya dua timbalan membuktikan, punca kemelut semakin rumit adalah disebabkan oleh Presiden itu sendiri," katanya.

Selain itu, beliau turut menyatakan bahawa dengan memanggil Pendaftar Pertubuhan (ROS) untuk campur tangan dan menentukan keabsahan kedua-dua jawatan tersebut memperlihatkan lagi kelemahan MCA selama ini.

"Dengan memanggil ROS, menunjukkan parti sudah hilang kredibiliti dan tidak boleh selesaikan sendiri masalah dalaman parti," katanya yang merupakan bekas Setiausaha Agung MCA.

Semalam Naib Presiden MCA Datuk Seri Liow Tiong Lai menegaskan bahawa desakannya supaya satu mesyuarat agung luar biasa (EGM) yang baru pada 28 November depan bukanlah kerana berkehendakkan jawatan.

Beliau berkata EGM yang dicadangkan itu bertujuan memastikan parti dapat memulihkan semula kredibiliti dan maruah bagi membolehkan MCA terus mendapat sokongan daripada masyarakat Cina serta orang ramai.

"Saya ingin menegaskan sekali lagi bahawa saya bukannya mengejar manamana kedudukan. Jawatan tidak penting bagi saya," katanya kepada wartawan di lobi Parlimen di sini semalam.

Liow, yang juga Menteri Kesihatan, turut menegaskan EGM kedua pada 28 Nov ini, adalah sah mengikut perlembagaan parti mengikut Artikel 27 di mana EGM boleh diadakan bagi membincangkan apa-apa permasalahan parti.

Beliau juga menggesa agar pemimpin-pemimpin MCA pusat menghormati EGM yang akan diadakan itu kerana ia adalah satu-satunya cara terbaik untuk menyelesaikan masalah dalaman parti.

Sementara itu, Ketua Pemuda MCA Datuk Dr Wee Ka Siong berkata isu untuk memanggil semula EGM baru adalah sah mengikut perlembagaan parti dan perkara ini telah dirujuk kepada pakar undang-undang.

"Kita juga mengingatkan Presiden bahawa tiada siapa yang berkuasa ke atas EGM yang dipanggil dan telah memenuhi syarat mengikut peruntukan 30.1, 30.2 dan 30.3," katanya.(hrkh)

驳反贪委“没有证人”说法 秘书指证林甘涉嫌贿赂法官

【本刊朱君明撰述】人民公正党副主席西华拉沙 (R.Sivarasa)早前声称要出面指证资深律师维卡纳林甘(V.K. Lingam)的神秘证人就是林甘的前秘书嘉燕蒂(L.G. Jayanthi)。负责替林甘订机票的嘉燕蒂驳斥反贪污委员会称“没法寻获主要证人”的说法,人民公正党国会议员质疑,政府是否企图掩盖林甘短片丑闻。

她表示,她在1998年就已就纽西兰行,向当时的反贪局给出完整的口供,这些供词都在皇委会的听证会复述了一遍。在皇委会的听证会过后,她在律师阿米尔韩沙(Amer Hamzah Arshad)的陪同下,给反贪委录取另一次口供。

嘉燕蒂在司法丑闻皇家调查委员会供证时,已向委员会形容,莫达西丁在陈志远起诉资深记者彼莱(MGG Pillai)诽谤索赔马币1000万元诉讼案的判词乃由林甘办公室负责撰写。

嘉燕蒂也透露,她知道几宗发生在林甘(右图)律师楼的事件,当时林甘和其他律师也协助撰写或草拟法官的判词,例如在阿依摩立(Ayer Molek)案,当时林甘代表其中一方。

瓜拉雪兰莪区国会议员祖基菲里阿末(Dzulkefly Ahmad)则认为,林甘一案严重破坏马来西亚在国际上的司法形象,“这不该是积极树立司法形象的国家应有的作法。”
木歪区国会议员倪可汉也指出,反贪委已拥有足够的证据对付林甘, “除非有证据证明他们无罪 ,否则这些人应被判罪。纳兹里需对其言论负责 ,否则将失去公信力,这对国家而言无疑是一场悲剧。”
负责拍摄“林甘短片”的格拉娜再也区(Kelana Jaya)国会议员罗国本和人民公正党班台拉惹区(Pantai Jerjak)州议员沈志勤表示,嘉燕蒂的做法值得赞扬,为铲除人民公敌作出很大的贡献,甚至要担心失去工作和人身安全。

哈迪自辩队长不能半途离场 回教党今通过五点临时提案

本刊黄书琪撰述 / 苏晓枫摄影】回 教党政治研讨会在哈迪自辩声中落幕,以足球比赛中途不撤换队长为自己辩护的哈迪,同时强调回教党不能只是一支“甘榜球队”必须虚心接受他人指教。另外,回 教党副主席沙拉胡丁出其不意在哈迪总结陈词前念出一份五点声明,并要求全场代表起立以示同意,通过这份临场草拟的议案。

由于回教党精神领袖聂阿兹(Nik Abdul Aziz Nik Mat)身体抱恙,于早上聆听哈迪阿旺(Abdul Hadi Awang)的开幕词后就离席就医,因此,哈迪阿旺在下午各州代表辩论之后,又发表了长达半小时的总结陈词。



这 一场背景特殊的政治研讨会形同亲巫统派系与亲民联派系的较劲场,虽然邀来撰写批评哈迪文章的国际回教大学教授阿都阿兹巴里(Abdul Aziz Bari)亲自说明,但显然回教党有半数中央代表依然不满其对哈迪的大胆批评,从早上到下午不断传出要球阿都阿兹巴里应当尊重哈迪,做出比较有礼貌批评的 声音。










至 于被点名遭到该党纪律委员会调查的雪州主席哈山阿里(Hassan Ali),他也于今早出席这场政治座谈会,纪委会主席端依布拉欣(Tuan Ibrahim Tuan Man)也向媒体透露,纪委会已经发函给数名雪州回教党领袖,要求他们在收到函件14天内回复解释。惟纪委会至今还没有收到覆函,他笑言:“可能还有人没 收到呢!”



值得一提的是,回教党副主席沙拉胡丁(Salahuddin Ayub)在下午的代表辩论环节结束之后,念出一份临时草拟的五点提案,并要求现场代表举手、起立表决通过,但现场可见部分代表依然坐在位子上,显然并不认同。


一、 继续加强民联,准备面对第13届全国大选,督促党领袖与党员积极参与民联行政;
二、 各区部领袖必须更加积极争取非回教徒选票,并让回教党支持者俱乐部能够更加活跃;
三、 透过各类研究加强回教党立场与原则,并影响基层彻底落实;
四、 设立关键表现指数(KPI)评估青年团表现,督促青年团吸引更多年轻人选票;
五、 落实、加强“全民回教党”的全国性运动。

DAP questions RM394m reserved for toll payments

KUALA LUMPUR, Nov 5 — The DAP is questioning the Budget 2010 allocation of RM394 million to compensate toll concessionaires for not raising toll rates, saying the government should renegotiate the contracts or take over the tolled highways.

Bukit Bendera MP Liew Chin Tong today noted the government had also paid RM180 million in 2009 and RM380 million in 2008 under the Works Ministry as similar compensation.

“It is crucial for the government to list the recipients of this huge amount of public funds and state why the budgeted amount for 2010 is more than double that for 2009, from RM180 million to RM394 million, though it was RM380 million in 2008,” Liew told reporters in Parliament.

He urged the government to rethink its approach towards toll concessionaires.

“While it is a populist move not to raise toll rates in 2008, the lopsided contracts between the government and the concessionaire mean that one way or the other the public is still paying for such daylight robbery,” he said.

Liew added that DAP had proposed that the government should renegotiate the “lopsided” contracts and privatised the highways.

“DAP has publicly articulated our proposal to privatise the North-South Highway from KLSE. We have estimated that by keeping the toll rate at the current level to finance the takeover, the highway will be a freeway seven years from the takeover day.

“This will end the eternal nightmare of a 10 per cent hike in toll rates once every three years,” he said.

Petaling Jaya Utara MP Tony Pua also questioned how the government calculated its “one-off” payments when the North-South Expressway’s accounts reveal otherwise.

“From the North-South Highway’s annual audited accounts, the gross toll compensation for 2007 is RM697 million but the gross toll compensation for 2008 is RM731 million; so just PLUS alone they compensated RM731 million so where did this number come from?” he asked. - Malaysian Insider

Kemelut MCA Tiada Penyelesaian?

Liow tolak tawaran sertai pelan perpaduan

KUALA LUMPUR: Datuk Seri Liow Tiong Lai, pernah ditawarkan menjadi sebahagian daripada pelan perdamaian lebih menyeluruh oleh Presiden MCA, Datuk Seri Ong Tee Keat, tetapi beliau menolaknya, kata sumber dalaman parti itu.

Melalui pelan itu, Liow diberi ruang untuk mengekalkan kedudukan sebagai timbalan presiden, manakala Datuk Seri Dr Chua Soi Lek pula akan dilantik sebagai setiausaha agung.

Bagaimanapun, Liow menolak pelan itu pada saat-saat akhir dan mengambil keputusan untuk terus membuat desakan supaya pemilihan baru diadakan bagi merungkai kebuntuan yang timbul hasil daripada mesyuarat agung luar biasa (EGM) pada 12 Oktober.

"Sejak beberapa hari lalu, Ong dan Liow mengadakan perbincangan melalui wakil masing-masing. Bagaimanapun, Liow tidak memberi sebarang keputusan.

"Ong menunggu di rumah beliau hingga tengah malam Isnin bersama wakilnya. Tapi, Liow tetap tidak muncul dan membuat keputusan untuk tidak menerima pelan perpaduan itu.

Sumber yang sama berkata, walaupun pelan perpaduan itu membabitkan semua pemimpin MCA, tetapi ditolak Liow dan kumpulannya.

Sumber yang sama, berkata dalam melaksanakan pelan itu dan bagi memenuhi selera kebanyakan kumpulan dalam parti berkenaan, tidak semua penyokong Dr Chua dilantik sebagai penyandang jawatan.

"Contohnya, tidak semua tiga ahli jawatankuasa pusat secara lantikan yang dilantik oleh Ong semalam adalah orang Dr Chua.

"Jika dilihat betul-betul, hanya anak lelakinya, Chua Tee Yong, adalah dari kem Dr Chua. Yang lain seperti Datuk Tan Chin Ming, sebenarnya lebih condong kepada bekas setiausaha agung MCA, Datuk Seri Ong Ka Chuan, manakala Datuk Donald Lim pula tidak memihak kepada sesiapa," kata sumber itu.

Bekas naib presiden MCA, Datuk Seri Dr Fong Chan Onn, berkata walaupun tidak syak lagi keadaan yang wujud sekarang sungguh membimbangkan MCA, tetapi ahli parti itu perlu memberi peluang kepada Ong dan Dr Chua untuk bekerjasama dan melaksanakan pelan perpaduan yang lebih menyeluruh.

"Sama ada EGM diadakan atau tidak, yang penting, pelan itu perlu mendapat sokongan ahli perwakilan. Oleh itu, pada EGM akan datang, pelan itu perlu diluluskan oleh ahli perwakilan," katanya. - Bernama

Krisis Dalaman MCA Makin Kusut, Kini Miliki 'Dua' Timbalan Presiden

KUALA LUMPUR, 3 Nov -- Krisis dalaman MCA semakin kusut setelah parti itu menerima keputusan Pendaftar Pertubuhan (ROS) bahawa Datuk Seri Dr Chua Soi Lek masih Timbalan Presiden parti itu Selasa.

residen MCA Datuk Seri Ong Tee Keat berkata mesyuarat Jawatankuasa Pusat MCA, Selasa sebulat suara menerima keputusan ROS itu dengan alasan keputusan Mesyuarat Agung Luar Biasa (EGM) MCA pada 10 Okt lepas tidak memenuhi keperluan dua pertiga majoriti supaya Dr Chua dilucutkan seperti yang diperuntukkan dalam Perkara 35 Perlembagaan MCA.

"Mesyuarat Jawatankuasa Pusat menerima usul keputusan ROS bahawa jawatan Timbalan Presiden tetap disandang Dr Chua Soi Lek, dengan itu Datuk Seri Liow Tiong Lai akan kembali menyandang kerusi Naib Presiden," katanya.

Ong berkata parti itu tidak akan menghalang jika Liow mahu mengemukakan rayuan berhubung keputusan itu selepas ini. Beliau turut mengumumkan bahawa mesyuarat itu juga menolak cadangan untuk mengadakan EGM bagi pemilihan baru parti seperti yang didesak 16 anggota Jawatankuasa Pusat itu sebelum ini.

Sementara itu, Dr Chua berkata beliau tidak terkejut apabila menerima surat keputusan ROS pukul 11.30 pagi Selasa.

"Setiap masa saya berasakan saya masih Timbalan Presiden jika merujuk kepada perlembagaan parti," katanya secara ringkas.

Satu sidang media berasingan diadakan untuk Liow menyatakan pendirian mengenai keputusan terbaru itu.

Liow secara sinis berkata MCA kini mempunyai Timbalan Presiden 'kembar' memandangkan beliau juga masih berhak untuk menduduki kerusi itu.

"Saya akan mencabar keputusan ROS, dan saya juga akan menggunakan hak saya untuk ke mahkamah untuk mencabar pengisytiharan ini," tegas Liow yang ditemani Ketua Pemuda MCA Datuk Wee Ka Siong dan Ketua Wanita MCA Datin Paduka Chew Mei Fun.

Liow berkata keputusan ROS itu melanggar perlembagaan parti kerana ROS tidak mempunyai hak mencampuri keputusan Mesyurat Luar Biasa MCA pada 10 Okt lalu apabila menolak resolusi ketiga supaya mengembalikan jawatan Timbalan Presiden kepada Dr Chua.

"Apabila Jawatankuasa Pusat menggunakan Perkara 174 bagi mentafsir dan mengenalpasti maksud Aturan EGM, ia tidak boleh dipersoalkan, dicabar, disemak semula atau ditolak olah mana-mana mahkamah perundangan.

Kedudukan ini adalah dengan sokongan penuh Seksyen 18C Akta Pertubuhan 1966," kata Liow. -- BERNAMA

DAP urges withdrawal of credit card tax

KUALA LUMPUR: DAP has urged the federal government to withdraw its Budget 2010 proposal to impose service tax on credit cards and charge cards as there is already adequate revenue for next year.

Its secretary-general Lim Guan Eng said the 2010 federal government revenue estimates showed it would have a net revenue gain of RM6.32 billion after taking into account tax changes proposed under the latest budget, adding that revenue involving the collection of income tax alone would amount to RM5.04 billion.

Lim said the government was expected to collect additional revenue of about RM555 million annually from the service tax on credit cards and charge cards, but should take into account that many employees only had minimal increases and marginal bonuses caused by the global financial crisis.

“If the service tax is on consumers then you will be taking RM555 million from the pockets of Malaysians. Those that will be severely affected will be basically from the lower income groups,” Lim told a press conference at the parliament lobby today.

Effective next year, the government will implement an annual service tax of RM50 on each principal credit card and charge card and RM25 for each supplementary card. The service tax is also imposed on cards that are issued for free.

Bank Negara Malaysia's statistics showed that there are about 9.8 million principal cards and some 1.3 million supplementary cards issued at the moment.

Lim pointed out that the spending and expenditure habits of Malaysians have not changed, and it was normal for average Malaysians to have three to four credit cards, stressing that the maximum 18% interest on credit card charges imposed by banks were much lower from loan sharks.

Lim, who is also chief minister of Penang, said that there would be virtually no impact on consumers should the service tax on credit cards and charge cards be absorbed by the banks instead, but remained sceptical if the institutions were willing to do so.-The Edge
