Ahmad Said Kata JKKK Wajar Letak Jawatan Kerana Buah Kurma Dan Air Zam-Zam Tak Sampai Kepada Rakyat

UALA TERENGGANU - Menteri Besar Terengganu, Dato' Ahmad Said sekali lagi mengkritik Jawatankuasa Kemajuan dan Keselamatan Kampung (JKKK) yang yang didakwanya gagal menjalankan tugas yang diamanahkan oleh kerajaan negeri.

Katanya, jika perkara itu berterusan, apa sahaja bantuan dan sumbangan yang diberikan kerajaan negeri tidak akan sampai ke tangan rakyat.

"Saya amat kesal dengan tindakan sesetengah JKKK yang tidak menjalankan tugas seperti yang diamanahkan sehingga menyebabkan rakyat menyalahkan kerajaan kerana bantuan tidak sampai.

"Jika perkara yang tidak sebesar manapun tidak dapat dilakukan, lebih baik mereka meletak jawatan sahaja," katanya kepada pemberita selepas menghadiri Majlis Berbuka Puasa anjuran Parlimen Kuala Nerus semalam.

吁政党向党员采取纪律行动 54团体联署谴责“牛头示威”

[本刊记者撰述】以维护媒体独立撰稿人联盟和回教徒专业论坛(Muslim Professional Forum)为首的54个团体联署谴责上周五在雪兰莪州莎亚南发生的“牛头示威”事件。他们呼吁相关政党对涉及散播仇恨的党员采取纪律行动,以莫让他们继续对自己所作所为沾沾自喜。

兴都教徒视牛为圣物,可是上周五约50名马来人回教徒竟携血淋淋的牛头,到雪兰莪州政府大厦前抗议雪州政府将一个兴都庙迁到马来人居多的莎亚南第23区。民联领袖皆认定,这场示威是由巫统一手策划,以在雪兰莪州制造乱象,进而达到推翻民联雪州政府的目的。【点击:牛头示威旨在制造乱象 在野党相信是巫统所为】临近国庆日发生“牛头示威”事件,54个联署团体感到震惊及悲愤,并促国人反思立国及“一个马来西亚”的意义。

他 们认为,“牛头示威”不该被视为两个信仰或两个宗教信徒的冲突;维护和平和人类的尊严是各大精神传统包括回教和兴都教的普遍及核心价值,对人类的爱让我们 永远追求和平、厌恶任何形式的仇恨和失序,可是令人感到悲哀的是,莎亚南发生的事件显示,暴力和仇恨依旧存在于我们的社会。

这54个囊括公民组织、回教徒组织、兴都教组织、基督教组织等团体的连署单位呼吁全体马来西亚人团结一致,以谴责和拒绝暴力和憎恨,以避免任何人或团体在面对城市规划争议及类似问题时,诉诸恐吓或煽动作法。

包括马来西亚宗教改革理事会(Jemaah Islah Malaysia)、马来西亚教会理事会青年团(Council of Churches of Malaysia (CCM) Youth)在内的54个团体在连署声明中提出以下六大意见:
(一)呼吁所有公民社会的争议通过和平的方式解决,如和平示威、理性对话、咨询和法律诉讼;非常赞同雪兰莪州政府举行市政厅会议,以促进其与利益相关者的沟通。

(二)
强烈谴责任何侮辱和恐吓任何种族宗教群体的举动,在这个事件上,即是非宗教及不负责任的展示牛头行径。这起事件非但侮辱和兴都教徒,也包括所有懂得思考的马来西亚人——回教徒、佛教徒、兴都教徒、基督教徒、锡克人以及其他精神传统的信徒及无神论者。

(三)
呼 吁所有宗教组织、社群领袖和政党毫无保留地谴责策划“牛头示威”者。这些盲目的种族和宗教人士亦该遭到社会尤其是他们代表的种族宗教社群疏远。政党也该对 涉及散播仇恨的党员采取纪律行动,因为这将可夺走他们因自以为是和逞英雄心理而产生的欢快和满足感。单单法律惩戒还不足够,因为这可能会让他们产生牺牲的 荣耀感。

(四)
支持彻查“牛头示威”负责人对当地兴都教社群和雪州政府发出的暴力威胁。在公民社会中,暴力威胁在任何情况下都不应存在。暴力该遭到谴责,而它只可能在社会对暴力绝不妥协,以及每一个触犯者遭到适当的惩罚的情况下丧失合法性。

(五)
对 警队无法阻止示威者威胁流血抗争表示震惊和沮丧。政府该即刻就警队的专业疏失进行独立调查,以检视警方为何没法维持治安以避免可能出现的种族及宗教危机。 这个事件更突显成立独立警方投诉及行为不检委员会(IPCMC,投委会)的重要性。如果纳吉政府真心诚意要维护马来西亚的和平,就必须成立投委会。

(六)
呼吁所有马来西亚人让暴力和仇恨去合法性,同时努力让暴力和仇恨从我们的公共生活中消失。且让这成为我们的国庆庆典的共同议案,让我们引领马来西亚成为一个爱好和平、理性论证、公正、自由、平等和融合所有马来西亚人的国家。

Gerakan Menolak Ong Tee Kiat

Pemecatan Chua jana Reformasi masyarakat Cina?

Pemecatan orang nombor dua UMNO pada tahun 1998 telah mencetuskan ledakan gerakan Reformasi dalam masyarakat Malaysia secara umumnya, dan masyarakat Melayu secara khususnya. Kelmarin, orang nombor dua dalam MCA telah dipecat, atas tuduhan mencalar imej parti kerana terlibat dalam skandal seks, yang didedahkan akhir tahun 2007.

"Memperlekahkan demokrasi! Mencantas akar umbi Chua! Kemusnahan MCA berpunca dari Ong!" Demikianlah antara slogan yang tertulis pada banner, oleh penyokong Chua Soi Lek yang menuntut agar Mesyuarat Agung Luar Biasa (EGM) diadakan, berusulkan pembuangan undi tidak percaya kepada Presiden Ong Tee Keat, dan mengekalkan keahlian serta jawatan Timbalan Presiden Chua Soi Lek.

Perbalahan antara dua pemimpin tertinggi dari parti komponen Barisan Nasional kedua terbesar ini telah diberi liputan yang luas dalam ruangan media bahasa Cina. Persoalannya, apakah pertembungan antara dua elit politik ini bakal menjana gerakan Reformasi dalam masyarakat Cina?

Tidak menyentuh agenda besar

Pertembungan antara Mahathir Mohamad dengan Anwar Ibrahim, walaupun cuba digunakan "skandal seks" sebagai isu, berakhir dengan perdebatan agenda besar seperti rasuah, kronisme, nepotisme, hak asasi manusia, keadilan, kepincangan sistem kehakiman dan sebagainya. Malah, masyarakat Melayu digegarkan dengan laungan "Reformasi", menyaksikan puluhan ribu manusia turun ke jalan raya menuntut perubahan.

Sebaliknya, pergelutan antara Ong Tee Keat dengan Chua Soi Lek, langsung tidak kesampaian untuk menyentuh isu-isu sebesar itu. Chua Soi Lek dihukum untuk kali kedua dengan dvd skandal seks yang sama, yang diibaratkan penyokong Chua sebagai "menyebat mayat".

Namun demikian, mengimbas sejarah pergelutan kuasa MCA, hampir tiada pertembungan yang berlandaskan ideologi, bahkan berpaksikan pendirian dalam isu-isu tertentu. Perselisihan antara Ling Liong Sik dengan timbalannya, Lim Ah Lek juga berpunca daripada pembahagian kuasa, di mana masing-masing mahukan anak buah mereka mewarisi tampuk pimpinan MCA.

Perbalahan ini bersinambungan sejak tahun 2000, sehingga isu pembelian Nanyang Holdings tercetus pada tahun 2001, membuka gelanggang agar kedua-dua puak ini bersilat. Isu "kebebasan media" diketengahkan, Team A yang dipimpin Ling Liong Sik menyokong untuk membeli syarikat media tersebut, sementara Team B yang diketuai Lim Ah Lek membantah pembelian tersebut.

Secara ringkasnya, isu "kebebasan media" hanyalah peluru kepada Team B untuk menyerang Team A. Isu ini dilenyapkan begitu sahaja apabila Chan Kong Choy dari Team B memperolehi jawatan Menteri Pengangkutan merangkap Timbalan Presiden MCA, setelah Mahathir Mohamad bercampur tangan mendamaikan kemelut MCA.

Campur tangan UMNO

Maka, isu pemecatan Chua Soi Lek kini diolah dengan hujah "sama ada ahli mahu MCA yang diperkudakan UMNO, atau MCA yang bermaruah untuk menentukan pucuk pimpinan dirinya".

Jelas, Ong Tee Keat memperjudikan nasibnya apabila melepaskan khabar bahawa seluruh pucuk pimpinan akan meletak jawatan, seandainya EGM diadakan untuk membatalkan keputusan Majlis Presiden kelmarin.

Malah, Pengerusi BN Najib Abdul Razak kini berada dalam kedudukan serba salah, sama ada untuk bercampur tangan dalam kemelut MCA atau tidak. Dalam perkiraan Ong, Chua perlu bergantung kepada "kuasa luar", iaitu Najib untuk bertarung dengan dirinya. Tetapi, seandainya tangan Najib dimasukkan ke dalam celah retakan MCA, maka Ong akan menyatukan sokongan akar umbi untuk melawan "musuh" dari luar.

Jauhi pengaruh UMNO?

Penampilan imej Ong sebagai "penentang UMNO" mungkin disambut baik ahli MCA, malah masyarakat Cina secara umumnya. Persoalannya, gerak-geri Ong Tee Keat ini tidak bermakna, sekiranya MCA gagal menjauhkan dirinya dari UMNO ketika penyelewengan, ketidakadilan dan penindasan berlaku.

Tsunami politik 8 Mac 2008 hampir mengaramkan MCA, pada ambang parti itu menyambut ulangtahun ke-60. Pemimpin MCA yang ditampar oleh pengundi, bertekad untuk "berubah sebelum diubah". Tetapi, sejak Ong Tee Keat mengambil alih pucuk pimpinan, apakah perubahan yang terlaksana?

Penganalisa politik, kolumnis di media internet mula mempertikaikan peranan yang dimainkan oleh Timbalan Ketua Pemuda MCA, Mah Han Soon yang menyumbangkan "warna kulitnya" untuk merampas kuasa kerajaan negeri Perak bersama UMNO.

Pemuda MCA yang diketuai Wee Ka Siong, kononnya akan bersuara lantang untuk memperjuangkan hak dan kepentingan rakyat, bagaimanapun berpeluk tubuh untuk memberi laluan kepada FRU membelasah peserta perhimpunan Mansuhkan ISA. Malah, kenyataan media daripada Setiausaha Agung Pemuda MCA, Chai Kim Sen yang cuba duduk di atas pagar dan mengkritik kedua-dua pihak polis dan peserta demonstrasi, dibidas sehabis-habisnya.

Masa depan MCA

Kegagalan MCA untuk memenangi sokongan pengundi Cina terbukti dalam semua pilihan raya kecil yang diadakan selepas PRU ke-12. Malah, apabila calon PAS daripada Pakatan Rakyat, Mohd. Nizar Jamaluddin memperolehi hampir 85% undi Cina di Bukit Gantang, mengharungi segala tuduhan "Negara Islam" yang dilemparkan, MCA diaibkan sebogel-bogelnya.

Jelas, MCA semakin hilang relevannya kepada masyarakat Malaysia secara umumnya, dan masyarakat Cina secara khususnya. Slogan "Tiga Lawan" yang dilaungkan Ong, "Lawan untuk ekonomi! Lawan untuk politik! Lawan untuk keharmonian kaum!" tiada kandungan yang konkrit, malah tiada kayu ukur untuk menilai sejauh manakah matlamat ini tercapai.

Berbalik kepada tajuk, apakah pergelutan antara Ong dan Chua bakal menjana gerakan reformasi dalam masyarakat Cina? Jawapannya mungkin. Sekiranya perebutan kuasa Ong dan Chua ini berjaya membawa kepada kemusnahan MCA, maka politik masyarakat Cina akan mengucapkan "selamat tinggal" kepada MCA buat selama-lamanya.

Dengan itu, reformasi mula terjana secara senyap dalam masyarakat Cina, selepas satu dekad "Reformasi" bergema di Dataran Merdeka.

Fong calls for Chua to be reinstated

KUALA LUMPUR, Aug 27 — Former MCA vice president Datuk Fong Chan Onn urged the party's central leadership to reverse the decision to sack deputy president Datuk Dr Chua Soi Lek.

"I'm concerned with the latest developments in the party... this is the time when we are supposed to strengthen unity within the MCA and Barisan Nasional," said Fong.

He added that Dr Chua was elected by the central delegates after his past history became public knowledge and the former health minister had even apologised for what he did.

"When the central delegates elected Ong Tee Keat and Chua Soi Lek as president and deputy president, they were fully aware of their background," said Fong.

"I hope something can be done. I don't like to see the party in a state of disarray," he added.

The Alor Gajah MCA chief was non-committal when asked whether he would support any attempt to call for an EGM.

"We do not have the luxury to continue fighting," he said.

Fong also took the opportunity to dismiss the rumour that he is part of the anti-Ong campaign.

"I support both Ong and Chua... as you all know since I retired as minister, I have been busy with my division," said Fong.

Dr Chua was sacked by the MCA disciplinary committee late last night and the decision was endorsed by the party's presidential council soon after.

The sacking is for Dr Chua's involvement in a sex video which was circulated in late 2007.

He later apologised to the public and resigned all party and government positions. - MalaysianInsider

'Tidak masuk akal' pecat Chua

Lim Kit Siang menyifatkan pemecatan Datuk Seri Dr Chua Soi Lek daripada MCA berhubung skandal seksnya awal tahun lalu sebagai "mengejutkan" dan "tidak masuk akal".

"Sudah tentu saya terkejut. Tidak masuk akal perkara ini boleh berlaku. Dr Chua dipecat ekoran apa yang berlaku pada Disember 2007. Kalau dipecat atas alasan lain, saya boleh faham," katanya hari ini.

Ahli parlimen Ipoh Timur mengulas keputusan Majlis Presiden MCA malam tadi yang memecat timbalan presiden MCA itu selepas menerima syor sedemikian daripada jawatankuasa disiplinnya atas dakwaan mencemarkan imej parti.

Bercakap dalam sidang media di ibu pejabat DAP di Petaling Jaya hari ini, Lim menjelaskan, beliau boleh memahami keputusan itu jika ada alasan kukuh, seperti berlakunya sabotaj atau halangan terhadap pelaksanaan dasar MCA.

Turut hadir, ahli Majlis Perbandaran Kajang (MPKj) Tan Boon Wah dan exco kerajaan Selangor, Ean Yong Hian Wah, yang juga bekas majikan mendiang Teoh Beng Hock.

Sementara itu, berhubung inkues kematian Teoh, Lim menuntut Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) memohon maaf berhubung keterangan pegawai penyiasatnya Mohd Anuar Ismail yang mengaitkan mendiang dengan kelulusan projek yang tidak wujud.

"Walaupun koronor Azmil Muntapha Abas telah memerintahkan keterangan itu dipadam, tetapi kerosakan (nama) sudah pun berlaku," katanya - Malaysiakini

“官员未表身份和带往何处” 黄传好否认拒绝反贪会逮捕

昨日遭反贪污委员会上门逮捕的雪州行政议员刘天球的特别助理黄传好,今日否认拒捕的指责,并反指有关官员没有表明身份和被带往何处,因此他被迫“逃命”。

他解释,本身是基于担忧自身安危,因此才在反贪会官员企图逮捕他时,作出挣扎。

“他们企图把我拷上手铐,但是他们却不曾说明身份,以及要把我带往何处。”

协议先报案才到反贪会总部


黄传好今日在行动党总部于多名党高层领袖的陪同下,举行新闻发布会,解释昨日发生的情况。

他说,他之前曾与5名反贪会官员有过协议,他将先前往警察局报案,然后才会被带往位于布城的反贪会总部。

“我要向警方报案,证明我当时还是活生生的。”

出示逮捕令未说明所犯何罪


他表示,当反贪会官员出示逮捕令,却没有说明所犯的罪行时,令他及两名律师感到惊讶。

不过,当黄传好踏出行动党双溪比利服务中心,旋即被数名便衣人士趋前,企图将他拷上手铐。

遭官员从后面抓住跌倒在地


当时,黄传好惊慌高呼,“我要我的性命,我不要死”。在挣扎的过程中,他遭到一名反贪会官员从后面抓住,结果他跌倒在地和膝盖受伤。

他昨晚被送入沙登医院照X光,并且迟至晚上10点获准以3000令吉保释。

虽然如此,黄传好坚称,本身依然会给予反贪会合作,因为这是他身为刘天球特别助理的职责。

他促请反贪会,日后不应以敌意来对待其他嫌犯或证人,就算是罪犯也应该获得人道对待。

林吉祥批评反贪会犹如流氓


出席今日新闻发布会的行动党国会领袖林吉祥批评,反贪会出尔反尔的行动犹如流氓,况且黄传好已经准备在报案后向反贪会报到,因此根本无需动粗。

他也质问,为何反贪会在未经调查之下,便前往逮捕黄传好。

“在巴生港口自贸区的120亿令吉丑闻中,他们有没有逮捕任何人?基尔的2400万豪宅又如何?难道他们可以随意根据猜测来抓人,进而引起恐慌?”

刘天球:为何没有出示身份?


刘天球也批评身穿便衣的反贪会官员,没有向黄传好出示身份。

“就连镇暴队如今也必须佩戴身份证明。难道反贪会官员就可以例外?”

他说,在最近一次的雪州行政议会已经议决,反贪会官员只可以索取州议员开支单据的副本,而不是正本,以避免出现篡改的问题。

Tiong tells Tee Keat to go ahead and sue

KUALA LUMPUR, Aug 13 — Datuk Tiong King Sing, the CEO of the main developer of the Port Klang Free Zone (PKFZ), will not retract his statement that MCA president Datuk Seri Ong Tee Keat had received a RM10 million donation from him.

Today, Ong said that he was giving Tiong seven days to withdraw his statement and apologise or else face legal action.

The transport minister also lodged a police report against Tiong this morning for alleged criminal defamation.

In an immediate reaction, Tiong told The Malaysian Insider that he stands by his remarks given in a media interview yesterday.

"I will not retract my statement. Why do I need to retract? I welcome him (Ong) to lodge a police report. He can go ahead and sue me," said Tiong.

When asked if he would be able to show proof that Ong had accepted the donation, Tiong said that he had witnesses to corroborate his story.

"I donated the money to the party to unite their members and serve the people well. I offered a cheque but Ong asked for cash because it was faster. I am very sincere in my intentions," said Tiong.

He added that it was not his intention "to condemn people" and that Ong was his "friend".

"When they were doing all the investigations, I did not ask for an injunction to stop them from making statements. What we are angry about is that the special task force that is doing the investigations did not call us for any explanations," he said, referring to the special task force that was established to probe any wrongdoing in the scandal-hit PKFZ project.

Ong was forced yesterday to deny allegations that he had received a RM10 million donation last year from Tiong, who is CEO of Kuala Dimensi Sdn Bhd, (KDSB), the main developer of the PKFZ.

However, he confirmed he had used the private jet owned by KDSB but he said his office was waiting to be billed for the services.

The allegations by Tiong, who is the Barisan Nasional backbenchers’ chief, will certainly give the coalition a headache.

The disclosure came after the special task force to investigate the PKFZ project said this week it had found disputed claims amounting to at least RM500 million.

Sivakumar calls for Perak assembly sitting

KUALA LUMPUR, 12 Aug 2009: Another showdown at the Perak legislative assembly is slated for 2 Sept 2009.

Embattled Perak Speaker V Sivakumar is calling for a sitting of state assembly to debate the royal address delivered on 7 May.

In a letter that will be sent out to assemblypersons tomorrow, the contents of which were made available to the media today, Sivakumar said the 7 May assembly sitting was disrupted because he was dragged out by police before the royal speech was delivered.

He said his orders as speaker on that day were also defied by Barisan Nasional (BN) assemblypersons and the three independents.

In February, Sivakumar suspended seven representatives, including the BN installed Menteri Besar Datuk Seri Dr Zambry Abdul Kadir, and six of Zambry's executive councillors. He also deemed the three BN-friendly independents who left Pakatan Rakyat to have resigned from their seats.

On 7 May, Sivakumar had ordered them to leave the House before opening the sitting. When they refused, fighting ensued in the state assembly until police were called in what was an unprecedented breach of the state legislature.

In his letter today, Sivakumar said "one [Datuk] Ganesan a/l Retanam asked the police to enter the assembly and dragged me out", referring to the BN-installed speaker whom Sivakumar is suing for battery, assault and false imprisonment.


Ganesan
Sivakumar is also asking the court to declare him as the rightful speaker.

"It is my duty as the lawful speaker of the Perak assembly to ensure that the affairs and proceedings are conducted in accordance with the Perak constitution and the standing orders of the Perak legislative assembly.

"It is clear that no business was transacted after the royal speech on 7 May 2009. Similarly, no business can be done before the royal speech.

"Therefore, as speaker, I now announce that notice to all members will be issued for the assembly to sit on 2 Sept 2009 to debate the royal address and to attend to all other business," Sivakumar wrote, signing off as the "Yang Di-Pertua" of the legislative assembly.

Further suspensions

In a separate press statement, Sivakumar said the Rights and Privileges Committee had met last week and summoned Zambry, executive council member Datuk Hamidah Osman, and Jelapang assemblyperson Hee Yit Foong to appear before the committee.

After those summoned failed to appear and after the committee members themselves were blocked by police from entering the state assembly building to meet, the committee decided to further suspend Zambry and Hamidah another three months each.

Zambry is now suspended from attending the assembly for a total of 21 months, and Hamidah a total of 15 months. The committee also slapped a RM250,000 fine on each one of them.

They were deemed guilty of violating their earlier suspension in February by attending the 7 May sitting.

Sivakumar, who chairs the committee, said Zambry had acted in further contempt of his initial suspension and in contempt of the Speaker's decision to reject a motion to remove him (Sivakumar).

Sivakumar said Zambry on 7 May had "orchestrated" Hee to preside as deputy speaker while Sivakumar was still present in the House. Sivakumar added that Zambry had also played a role in getting Ganesan elected as speaker when the House was not in session yet, as the Perak regent, Raja Nazrin Shah, had not yet delivered his royal address.


Hee
Hamidah was also charged for being in further contempt of her initial suspension by attending the 7 May sitting, and for ignoring Sivakumar's order to leave the House. She had also seconded a motion to remove Sivakumar as speaker, and had a "central role in the farcical election of Ganesan" as speaker.

Hee was charged with refusing to leave the assembly when Sivakumar had already deemed her seat vacant. She was also charged for violating the pledge letter she signed with her former party, the DAP, that she would pay RM5 million and step down as assemblyperson if she ever left the party.

Hee had also wrongly presided as deputy speaker on 7 May while Sivakumar was still in the House, the committee held.

It recommended that Hee be jailed for six months and fined RM10 million for her "prominent role in the farcical proceedings before the assembly opened"

坊间传说张庆信(左图)曾捐出1000万元给马华公会,可是这笔捐款去向未明。张庆信接受《独立新闻在线》询问时证实,他去年曾捐出1000万元给马华公会。
张庆信指称,当时翁诗杰甫出任马华公会总会长职,急需现金拨款到马华公会区部,因此他没有问清楚拨款用途,就基于支持翁诗杰“重振华裔子弟”以及“整顿马华公会,让马华公会党员团结一致、不分彼此,诚心诚意为社会服务”,而分三次捐出这笔款额。
问道是否翁诗杰亲口要求他捐出这笔现款,也是砂拉越民进党籍民都鲁国会议员的张庆信说:“他的其中一个朋友叫我支持,因为他刚刚出来做领导。”
问及为何要交现款,他回应:“因为他说他要马上交给他的(马华公会)区部。”记者继问,翁诗杰一方是否有具体说明这笔款项的用途,张庆信说:“我没问details(详情),我支持他,相信他,我一直有交待他要重振华裔子弟。”
记者再问,这笔款项是否直接交到翁诗杰手中,张庆信表示,其中两次是交到其属下手中,其中一次则是直接交到翁诗杰手中。
他表示,他捐出了这笔款项之后,还对翁诗杰说:“以后有什么事我可帮到的,再联络。”
否认因翁是部长而捐款
记者询问张庆信,他给翁诗杰捐出这笔款项,是否还有别的原因?随之提醒他,翁诗杰有交通部长一职。张庆信回应:“他有portfolio(职位)我支持,没有portfolio我也支持。”
接着他补充说,他也经常捐款协助其区部和其他人的区部。他乃痛心华人的现状,才捐款支助翁诗杰。
他说:“我爱这里,不爱我才不理。我最多移民,选择不看,但是我走了,还有很多亲戚朋友在这里。”
翁诗杰(左图)上任之后积极追查巴生港口自由贸易区弊案而与张庆信杠上,不利翁诗杰的消息接踵而来。早前翁诗杰还以“遭四面埋伏”形容自己的处境。
记者询问张庆信,他是否因翁诗杰追查自贸区弊案而揭露捐款一事,张庆信说:“他要查要做什么都可以,这事跟那事有什么关联?他要去做,我们不怕。”
提及翁诗杰拖欠其公司飞机费用一事,张庆信情绪如火上加油:“我在国油打油,它给我免费打呀?你要用免费的,你当然要跟我讲。”
他还说:“做人不要转来转去,不要讲到自己太过嚣张。”记者反问他是否指翁诗杰嚣张,他回应:“为什么不嚣张?你在你党内逞英雄,讲到自己多么清廉,现在你自己党内的人讲没有收到钱!”
马华公会部落客满腹疑问
张庆信捐款失踪一事是由马华公会党内的部落客率先在部落格揭露,接着马青中委林文议发文告指责部落客散播谣言以推翻和破坏马华公会领袖的声誉。署名“曾聒”的马华公会部落客刘振国在其部落格在其部落格指出,这个传言在政界已经流传甚久,他认为此事犯上了多处逻辑上的错误,即:
一)为什么马华公会会要求张庆信捐款?
二)马华公会凭什么要张庆信捐钱?
三)张庆信为何要捐1000万元给马华公会?
四)翁诗杰明知巴生自由贸易区是由问题,为什么还要向所谓问题根源要求捐款或是领取有关捐款?
五)2008年1月,当商业巨子陈志远捐献1000万元予华社时,马华公会光明磊落地出动了三个部长和一个副部长领款,更召开记者会当面感激陈志远,如果传言中的1000万曾经出现过,而且是直接捐献马华公会,马华公会不可能完全没有动作

Demonstrations: A fundamental right of citizens

It would be an untruth if I said I was ever a fan of Datuk Seri Najib Razak. Be that as it may, I am sorry about his coming into office, unlike all his predecessors, weighed down by the heaviest baggage imaginable, stuffed up to the neck with allegations of impropriety that I’d rather not bore you with.

I will not enumerate them either as they are too many. Also it would be pointless to waste our time dwelling upon unproven allegations that should have been nipped in the bud before they got out of hand, but for some unexplained reason, Najib had allowed them to fester like tropical sores on his credibility and honour.

I, like many other Malaysians, want very much to keep an open mind. We earnestly hope that he will give serious consideration to confronting, in a court of law, those who have defamed and reviled him.

His studied indifference might be considered by some to be an appropriate response, but he is not helping his own cause. He is pandering to the insatiable appetite of the noisy rumour mongering, chattering classes.

People are not giving Najib the benefit of the doubt that he craves for. His moral legitimacy to govern is being seriously challenged because of his cavalier attitude to these extremely damning allegations.

I am not about to dispute his legitimacy to govern based on the mandate given to the Barisan Nasional by the people as part of the electoral process, but that, without an underpinning of high ethical standards of behaviour, renders a leader morally deficient.

Conventional wisdom has it that in the sticky situation he has found himself, the only recourse is for Najib to take those who have maligned him to court and clear his name, once and for all. People are asking “Why is he fighting shy of seeking justice in a court of law unless he has something to hide?” They have a point there.

For the sake of what is left of the country’s already battered reputation, and his own, he should clear his name sooner rather than later. Najib’s 1 Malaysia requires of him that he put the interest of the nation above his own.

We cannot have a prime minister who is not prepared to answer these serious allegations about his involvement in some seedy criminal activities, or those bordering on the criminal, and yet who expects us to embrace his yet hazy and unclear 1 Malaysia and to shower him with our trust and affection.

I know all these allegations may have no basis in fact and, therefore, all the more reason for Najib to let the criminal justice system be the arbiter of truth. Perceptions may not have any basis in fact, but they are real.

Najib wants so desperately to be loved, and to be well thought of. I see nothing wrong with that. It is just a silly bit of misplaced, self-serving egoism, a very human weakness most of us suffer from, but it is a harmless desire. However, there is everything wrong, if as rumours have it, public funds are being used to pay international and local spin doctors to bolster up his position.

Mahathir, when he was prime minister, so we are told, used public funds to have a meeting with President Bush arranged to boost his flagging international reputation. We expected this of Mahathir, a man of many contradictions with few scruples, but I should like to think that Najib is made of stronger and finer moral fibre, but then I could be wrong.

I am ecstatic, more than any one can imagine, by Najib’s strong rhetoric against corruption. I use the word “rhetoric” advisedly because while we have heard many populist pronouncements rolling off his smooth silvery tongue on a variety of issues, we are still waiting to see the colour of his money. Will he deliver as promised?

For someone who has been on the receiving end of countless allegations of perceived unethical public conduct relating to purchases of military assets during his watch as defence minister, he is right to want to distance himself from any further insinuation of impropriety.

Defence contracts are notoriously susceptible to corrupt practices the world over and because of this, people simply will not believe that a defence minister can be clean and pure as the driven snow, or be like Caesar’s wife, completely above suspicion especially when the procurement process is shrouded in secrecy and mystery, as ours is and has been for years.

For this, if not for any other reason, if I may be so bold as to advise Najib, he should order a complete review of the defence ministry’s procurement rules and procedures at once and bring them in line with best international public procurement practice.

The purpose of any procurement systems review is to ensure the highest degree of transparency. Without transparency, there is no accountability. Najib has a lot on his plate, and as they say, he has his work cut out for him, lucky him.

Minutes before writing this article, I had just finished reading, for the second time after a lapse of some years, F.W. De Klerk’s “The Last Trek – A New Beginning.” He was, of course the President of South Africa who dismantled apartheid and gave the people of that troubled nation a new democratic constitution which saw the once proscribed African National Congress in the seat of power after winning the general elections in 1994.

I mention all this because in spite of the fact that the Republic of South Africa had been under a state of emergency and under siege, De Klerk, in 1989, a few months before his inauguration as President, made a conscious political decision to legalise protest demonstrations that had been made illegal until then, much to the consternation of his security advisers. They thought it was madness on his part given the circumstances prevailing at the time. Why did he do what he did? Let him tell us in his own words:

“We were faced with the fact that it would be impossible to avoid the gathering of thousands of people committed to the march. The choice, therefore, was between breaking up an illegal march with all the attendant risks of violence and negative publicity, or of allowing the march to continue, subject to the conditions that could help to avoid violence and ensure good order. These were important considerations, but none of them was conclusive. The most important factor, which tipped the scale, was my conviction that the prohibition of powerful protests and demonstrations could not continue. Such an approach would be irreconcilable with the democratic transformation process that I was determined to launch and the principles of a state based on the rule of law, which I wanted to establish.”(Italics mine.)

In terms of the security and public order situation then obtaining in South Africa, and the situation in Malaysia today, where peaceful demonstrations are illegal, the two situations do not bear the remotest resemblance.

The justification trotted out with regular monotony by the government is so outrageously dishonest as to insult our intelligence. A government that sees a need to continue to impose an undemocratic law has no place in a parliamentary democracy. For F.W De Klerk, the man who worked himself out of a job, it was nothing more than “restoring what was regarded throughout the world as a basic democratic right.” (Emphasis mine)

Perhaps De Klerk’s most inspiring statement in defence of democratic principles is “…..no vision of the future can justify any government to ignore the basic human rights of the human beings involved. No cause is so great that we should allow it to dilute our sense of justice and humanity.” (Emphasis mine)

On that note, as our legal friends would say, I rest my case. Now over to our self-proclaimed reformist prime minister.

發現2新疑點 哥賓星吁從被推下角度重查


(莎阿南7日訊)趙明福家屬代表律師哥賓星,今日要求警方調查兩項新發現的疑點,以及要求警方從趙明福被推下樓致死角度重新調查這宗命案。

“一直以來,驗屍庭程序都朝向趙明福失足或自殺的推斷角度來進行;而沒有考慮到死者可能是被推下來。”

他說,他將向驗屍官阿茲米爾提呈申請,要求他下指令給警方,從推下樓的角度重新調查此案。

他也說,他今天在趙明福臥屍地點,即瑪沙南大廈命案現場勘查程序中,發現兩項新疑點,他促請警方著手調查有關疑點。

但他拒絕進一步透露兩項疑點;只說已向警方提出申請,要求調查有關疑點。

“(有關疑點)目前不方面公開,有待驗屍庭開審時才揭曉。”

哥賓星今日在隨同驗屍官阿茲米爾、總檢察署代表律師陳福泉,和一眾相關警方人員和律師代表,前往瑪沙南大廈的命案現場進行勘查程序后,如是指出。

他說,控方、家屬、律師公會及雪州皆派代表前往勘查命案現場,過程中他也向有關當局提出不少疑問。

針對驗屍庭的現場勘查範圍,他說,他們已勘查雪州反貪委會總部14樓的辦公室,包括會客室及盤問室,及位于15樓的部分辦公室。

受詢有關疑點是否趙明福墜樓窗戶時,他回應,有關窗戶是位于盤問室隔壁,一間空置的房內。

他補充,驗屍庭在下週一開審時,將傳召3名法醫出庭作證,包括為趙明福進行解剖的法醫;預料負責調查本案的鑑證專家,也在週三受召出庭供證。

(雪蘭莪‧沙亞南)警方沒有指示化驗師檢驗趙明福遺體的腎上腺素水平,使到家屬代表律師大表不滿,並拋出一句“趙明福是否被人從高樓推下致死”;總檢察署代表律師和家屬律師更為此展開激辯。

這也是驗屍庭自開庭以來,次出現“趙明福是否被人推下”的“敏感”字眼。

第7證人大馬化學局毒理學化驗師查萊哈指出,若趙明福是被推下或墜樓,其腎上腺素會上升;但是警方沒有指示她檢驗趙明福的腎上腺素水平。

“因此,不能由腎上腺素水平來確定趙明福在案發當天是被人從高處推下或墜下。”

哥賓星在盤問查萊哈時,因不滿證人做事“一板一眼”,只遵從警方指示為趙明福進行化驗,反問證人是否曾在報章看到,有超過一個猜測指趙明福是被人從高樓推下致死?

這引起總檢察署代表陳福泉律師的烈不滿,兩人你一言、一語,在庭上爭得面紅耳赤。

陳福泉:不應拋出假設字眼

陳福泉認為,成立驗屍庭的主要目的是鑒定趙明福死因;不過,在驗屍過程結束前,哥賓星不應拋出“被人推下”、“自殺”等假設性字眼。

“驗屍庭不應允許律師向證人發出不公平的問題!同時,不必接納和記錄哥賓星的問題。”

較後,他補充說,哥賓星可選擇向雪州反貪委會的官員提出這項疑問,但對象不應是化驗師,更不能要求化驗師證實報章的揣測性疑問。

哥賓星反駁說:“若驗屍庭不允許律師提及被人推下、自殺等字眼,那為何要設驗屍庭?我們為何要委任自己的法醫?”

他說,律師不能只根據化驗報告發問,然後交由驗屍官一人去鑒定死因。

“我們要通過種種理論協助驗屍庭鑒定死者死因,否則,我為何要在這裡?我應該回家才對!”這得雪州政府和大馬律師公會旁聽律師的認同。

Kit Siang accuses IGP of ‘offering up Pakatan heads’ in exchange for extension

KUALA LUMPUR, Aug 5 – DAP’s Lim Kit Siang today accused the Inspector-General of Police Tan Sri Musa Hassan of targetting top Pakatan Rakyat (PR) leaders over last Saturday’s anti-ISA rally to get his contract renewed.

In a statement today, Lim said that Musa’s declaration that top PR leaders were responsible for Saturday’s anti-ISA rally was a sign that he was on a personal vendetta against the opposition for campaigning against the renewal of his service.

Yesterday Musa reportedly said that 11 VIPs including Opposition Leader Datuk Seri Anwar Ibrahim will be called in as part of an investigation into Saturday’s rally which was attended by some 20,000 people.

“If further evidence is needed, Musa has provided the latest testimony of the personal vendetta he is waging against me and other Pakatan Rakyat leaders,” said Lim.

Last week PR parliamentarians convened a roundtable to demand the government not to renew Musa’s service for his failure to curb increasing crime rate.

Musa, who reached retirement age in 2007, was given an extension of two years which will expire next month.

“Musa has come to the conclusion, and he makes no bones about it in public, that the Pakatan Rakyat leaders from PKR, PAS and DAP, namely Datuk Seri Anwar Ibrahim, Datuk Seri Abdul Hadi Awang and I, are the ‘masterminds’ of Saturday’s gathering,” said Lim.

“Is Musa offering the ‘heads’ of the Pakatan Rakyat leaders from PKR, PAS and DAP to the Prime Minister, Datuk Seri Najib Razak and the Barisan Nasional government in exchange for another renewal as IGP in September?” asked Lim.

The Ipoh Timor MP added that if Musa’s service is renewed it will be the first time in the country that the No 1 policeman is given two extensions.
